Day 154 - 13 Jul 95 - Page 11

response to the original statement made. That is how
I imagine it may have occurred. As I recall it, it did not
       ever get to that stage.

  Q. They took heed of your threat, presumably?
       A. I would not call it a threat. It was a sort of
friendly warning, I would call it.

  Q. Well, some people might perceive disciplinary action as a
       threat.

MR. JUSTICE BELL: I wonder whether you actually had anything
particularly in mind? Did you have any particular step in
mind, or were you just saying: "Cool it, or there will be
trouble", without thinking what might happen?
       A. What I could imagine might have happened is that
I would have said to them that, "Come on, lads, this is
getting a bit sort of ridiculous. Can we just sort of get
on with the work and stop messing about?"

  Q. Anyway, your case is that it all evaporated anyway?
       A. It evaporated very quickly, yes. I am really surprised
to actually see it as part of the case at all, to be
       honest.

MR. MORRIS: Why should people not walk off a shift if they have
       a dispute with the management?
       A. Why should they not walk off shift?

  Q. Yes. Obviously, it means disciplinary action, you would
       have no choice. Why?
       A. It depends on what the reasons were why they walked off
shift. If there was no particular reason why or any
reasonable excuse for walking off the shift, then dependent
on the incidents and the situation, you have to make some
sort of decision. Obviously, you cannot just have people
walking in and walking out when they feel like it.

  Q. No. But the context was there was a dispute, you said ---

MR. JUSTICE BELL: No, is that -----

MR. MORRIS: -- a disagreement with the shift running manager,
you said, and you remember -----

MR. JUSTICE BELL: What do you remember about the disagreement
       with the shift running manager?
       A. Virtually nothing. I could just remember -----

MR. MORRIS: There was a disagreement?
       A. There may have been a disagreement.

  Q. Did you threaten the manager with discipline for upsetting
the staff? Did you say: "There will be trouble if you
       carry on upsetting the staff"?
       A. I do not agree that the manager necessarily upset the
       staff.

  Q. You are saying that the workers got threatened that there
would be trouble after this incident?
