and that would be the most senior person in the restaurant
       at the time, so -----

  Q. Who, generally, would that be? Who would be responsible
       for that?
       A. Myself, the first assistant or one of the second
       assistants.

  Q. Simon Gibney says: "I was a Shift Running Floor Manager
which means I was often the Manager responsible for the
whole store regularly with no other Managers present.
Because I was under 21, I was unable to progress to
salaried management, but my duties were just the same as a
Second Assistant Manager". So were there times when Floor
Managers would take on that role if there was no salaried
       management?

MR. JUSTICE BELL: Why not stick to Simon Gibney for the moment
and then find if it is the general practice.
(To the witness): Do you accept that Simon Gibney, as a
Floor Manager, would run shifts from time to time?
       A. Yes, he would on rare occasions, yes.

MR. MORRIS: So you had one First Assistant Manager and one
       Second Assistant Manager?
       A. It varied throughout the time that I was there. At one
point we had three Second Assistants, at another point we
had two. The most common set of numbers was one Manager,
one First Assistant and two Second Assistants whilst I was
       there.

  Q. So there were three people under you with clear shift
       running powers?
       A. That is right.

  Q. Plus Floor Managers from time to time?
       A. Yes, by Shift Running Manager or how we used to term a
Shift Running Floor Manager was a Floor Manager who, if the
need be, could step in and actually run a shift.

  Q. Right. So, anybody that was running a shift would liaise
       with the crew people directly?
       A. Yes.

  Q. They might say to people: "Do you fancy staying?" or "We
need some extra people", that kind of thing?
       A. If it happened on the rare occasions that it would be
       needed, yes.

  Q. That you would need more people to stay on or whatever.
You did not, presumably, listen to every conversation by
every Shift Running Manager with every crew person
regarding to whether they wanted to stay on or not?
       A. No.

  Q. Just trying to go through this in some sensible manner:
Going over to page 8 of your statement, first statement,
paragraph 19, you accept as true, yes?
       A. Yes.
