Day 145 - 29 Jun 95 - Page 11

concerning it, periodic announcements, concerning it.
There are posters in stores. There are quarterly
statements for those who are participating in it of their
account balances. That is what I can tell you.

MR. JUSTICE BELL: What are you looking for, Ms. Steel?

MS. STEEL: There was something I wanted to ask about and
       I cannot find.

MR. JUSTICE BELL: Let Mr. Morris carry on and come back to it
because we really cannot just sit in silence while you try
to find something which you need for your
       cross-examination.

MS. STEEL: It is within this document.

MR. JUSTICE BELL: Can you continue, Mr. Morris, and then
Ms. Steel can come back to it when she finds what she
       wants?

MS. STEEL: Just on page 369, it says about eligibility.

MR. JUSTICE BELL: Tab 8 again, are we?

MS. STEEL: Yes, sorry, I thought we were still in tab 8. It
says about eligibility for profit sharing. It says: "If
you are a full-time staff or salaried store management
employee" -- it does imply, does it not, that it is not for
       part-time staff?
       A. No, it does not. The book that you are reading from is
the manual specifically to full-time staff and to
management. This does not refer to part-timers at all.
This is the book that we are directing specifically to the
people who we have suggested, the full-time staff and
managers. We are talking about two different documents.
We have had a Crew Handbook and then this is a different
       book.

  Q. I will just move on to something else which is within this
same document, so do not close it yet: We have seen the
standards for performance reviews in the UK documents.
       A. OK.

  Q. "Good" is meets all job requirements and expectations.
Does that tally with the standards in the USA?
       A. Yes, in general.

  Q. What happens if crew do not meet the standard?
       A. They would be alerted and told that they need
improvement, and they would be given a specific performance
review that would outline what they need to improve upon
and what the plan should be to improve their performance.

  Q. If they do not come up to scratch then eventually they
       might be terminated?
       A. Well, there would be a reasonable period of time and we
would hope to see improvement, a reasonable period of time
over which to accomplish the goals, and if there was not
improvement, yes, they would be terminated, sure.
