Day 144 - 28 Jun 95 - Page 73
have to ask about documents such as that: Does that
reflects corporate thinking?

MR. RAMPTON: My Lord, an obvious example that has arisen today
or yesterday, I cannot remember now -- it is all a blur --
would be that memorandum from Germany by Herr Sperca which,
I would say, is plainly not a McDonald's document at all.

MR. MORRIS: That is absolutely ridiculous! That came from the
Personnel Department.

MR. JUSTICE BELL: But the point of mentioning it is to
illustrate that there may be some argument about that and
it may have to be canvassed in evidence. But when we come
to Operations manuals and matters of that kind, you do not
have to rehearse the contents with the witness, unless you
want to seek some additional information to what appears on
the face of the page.

MR. RAMPTON: I can say this, before Mr. Morris gets excited
about a proposition of that kind, it behoves him to take
legal advice because it is not just a question of fact, it
is a question of law as well, whether that is a McDonald's
document or not.

MR. JUSTICE BELL: I did not mean to get involved in that. I
was trying to help about what you need and need not do.

MR. RAMPTON: No, I am just saying, it is not just what
Mr. Morris may think.

MR. JUSTICE BELL: Having said that, I have an appointment so I
do not want to go on too late but, first of all, what is
the best estimate for time?

MS. STEEL: We are about 90 per cent certain of finishing
tomorrow.

MR. JUSTICE BELL: Yes, very well. Hopefully, you will. If you
do not, it does not sound as if you will use much on
Friday. Let us try to finish tomorrow.

MR. RAMPTON: My Lord, I make another plea ------

MR. JUSTICE BELL: Yes, I am going to ask about that. What
about the list of matters you want dealt with?

MR. RAMPTON: I remind your Lordship that Mr. Morris said on
Monday that he thought he would have it done in 24 hours
but he was not sure.

MS. STEEL: I said I did not think he would.

MR. JUSTICE BELL: Just tell me what the situation is at the
moment.

MS. STEEL: We have not got a final document, a final kind of
list to hand over, so I will just read out. There are
amendments to the Defence pleadings; there is the argument
about Jarrets which I think they have put in there and
