Day 144 - 28 Jun 95 - Page 69

evidence was given that McDonald's somehow claims it has
the greatest percentage of black franchisees than any
       fast-food organisation.

MR. JUSTICE BELL: If you want to pursue that, you will have to
think about how, if at all, you can set about putting up
some contrary evidence, but it is obvious Mr. Stein cannot
       help you.

MR. MORRIS: To us, it is not an issue in the case, but it is
something dealing with some evidence that was brought up
       earlier on.

MR. JUSTICE BELL: If you do not think it is an issue, you do
not have to pick up the gauntlet.

MR. MORRIS: No. I am dealing with lots of bits and pieces
because it is at the end of the day. (To the witness):
Mr. Stein, in your capacity as Chief of Human Resources, do
you concern yourself with the relationships between
employees and customers and how employees' conditions of
work relate to the way they relate to customers?
       A. You need to get more specific than that.

  Q. I will give you an example which I am not going to ask you
about, but we have the smiling at customers policy, or
whatever, and that may impact on employees' conditions of
work, something which they have to do. All I am saying is
things like that, that comes under the general heading of
Human Resources, does it? It comes under the conditions of
       work for staff?
       A. We like our employees to be pleasant, to greet the
customers in a proper fashion as any guest would want to be
treated, but I am not sure where you are going.

  Q. If I could refer you to -- McDonald's crew -- it is called
Crew, is that the American Newsletter for McDonald's staff?
       A. I wish my eyesight were good enough to see that.

  Q. Sorry, it is called "Crew". I think in England it is
called "McNews", do you know of that? The newsletter for
       all employees ------
       A. Oh, you are talking about Crews' Views?

  Q. Yes, I think it says: "Crew. September/October 94
published by McDonald's Corporation for crew members"?
       A. That would be what I would call "Crews' Views".

  Q. OK. If we could go to that document -- maybe this will be
a suitable place to end up.

MR. JUSTICE BELL: Yes, make this the last one then. What is
       the reference?

MR. MORRIS: It is document 15 in our additional supplementary
list of employment documents, the most recent list.

MR. JUSTICE BELL: It is No. 6 of the Defendants' supplementary
-- it is the last document in it.
       A. The last document is something different, my Lord.
