Day 144 - 28 Jun 95 - Page 68
want you to refer to it until at least you have produced it
to the other side, Mr. Morris.

MR. MORRIS: Yes, I was not going to rely on it or even
necessarily refer to it. I was just going to ask whether
the witness was aware of it, then he might himself, you
know -- I will ask a general question then. He has heard
of it anyway.

MR. JUSTICE BELL: Are you aware of McDonald's appearing or not
appearing in any listing in the magazine?
A. My Lord, the only thing I am aware of is that Black
Enterprise magazine has recognised McDonald's from time to
time as a premiere employer and premiere organisation as to
the numbers of blacks that are franchisees compared to what
exists elsewhere in the industry. There have been many
references that I have -- "many" -- there have been three
or four times that it has been brought to my attention that
there are positive articles on McDonald's concerning our
employment and concerning our franchisees.

MR. MORRIS: In 1993 is it the case that about 5.4 per cent of
McDonald's units were black owned?
A. Oh boy, I have no way of knowing, my Lord.

Q. Something like that, do you think that is a reasonable
figure?
A. I have no way of knowing. The Licensing Department
would keep those kinds of matters, I assume. Now I am
doing what Mr. Beavers did, so I have to stop myself right
there. I am trying to be helpful, but the reality is I do
not have that information. I think I have mentioned to you
that things involving licensees, I do not really get
involved in. I get involved with things involving the
employment relationship.

Q. Have you heard of Popeye's Churches fast-food company?
A. They are a chicken outlet in the US.

Q. Have you heard of Tom's Foods, snack food ---
A. No, I have not.

Q. -- company?
A. No, I have not idea who that is.

Q. With 354 outlets?
A. No, probably -- it maybe somewhere in the south, but
I am guessing. No, I am guessing. I am trying to be
helpful and I am going too far because I do not know.

Q. Just for the sake of argument ---
A. I have never seen one.

Q. -- we are just concentrating on Popeye's Churches: Would
you accept that Popeye's Churches has a greater percentage
of black franchisees?
A. I cannot do that because I do not know what they have
and what they do not have.

Q. It is just because I think, just for explanation, that
