Day 144 - 28 Jun 95 - Page 65

but we should definitely finish tomorrow I should think.

MR. RAMPTON: My Lord, "I should think" with respect is not
really good enough in view of the promises, I take them as
promises, we have had over the last month.

MR. JUSTICE BELL: No, we have had an indication that we would
       finish on Thursday.

MR. RAMPTON: Yes, I was not expecting them to finish tonight.

MR. JUSTICE BELL: I have said that Mr. Stein must be finished
by the end of the week. It would obviously please me if he
can be finished tomorrow, but we have had nothing which
I would understand as a promise that he would finish
tomorrow. We have had an indication that that would be
so. What I have said is if we were not going to live up to
that I would like Ms. Steel and Mr. Morris to let me know.
We must finish by Friday so that Mr. Stein can be released
from this court on Friday at the latest. If we run into
Friday I am afraid it means that the preparation day or
part of it goes, but there we are.

MR. RAMPTON: I do not know whether this is the moment to
mention it, but your Lordship did say I think on Monday
that the Defendants should let your Lordship and us have
their list of interlocutory topics today.

MR. JUSTICE BELL: Let us go on until about five or 10 past four
and then we will have five or 10 minutes, if needed, to
talk about the schedule and where we are going next. How
much time do you want, Mr. Morris? Do you want to sit
       there and think about it?

MR. MORRIS: If we could have five minutes to collect our
       thoughts? It would be helpful.

MR. JUSTICE BELL: I will come back at 10 to 4. I would like
you to get yourself prepared for another quarter of an hour
or 20 minutes cross-examination, think a bit more about
what you think the real timing is and be prepared to be
helpful about your list of interlocutory matters you would
       like to be dealt with.

                      (Short Adjournment).

MS. STEEL: In this country, Mr. Stein, we have heard that the
Company keeps a record of the reasons why people left
moment at McDonald's by way of a termination code which is
kept which is put into a computer and kept on record. Is
there a similar situation in the USA?
       A. No. It is done at the store level, kept in the store
level, in store files. We do not have the capacity to put
it into the computer or get anything off that.

  Q. Even for McOpco stores?
       A. Even for McOpco stores. I can have access to that
information by going to individual stores and I do and
       taking a look at it.
