Day 144 - 28 Jun 95 - Page 59

tried to explain that we are trying to adduce evidence now
and at the end of the case you will have an opportunity to
make such comment as you see fit to make, which can include
references to the transcript, to urge upon me, if you think
it right to do so, that this witness or that witness was
trying to avoid the thrust of the question. But that is
       for later, not now.

MS. STEEL: Mr. Stein, the Corporation's Operations Manual, that
is sometimes referred to as the McDonald's Bible, is it
       not, I believe?
       A. Maybe you have. I do not consider it the Bible.

  Q. No, but is that something that sometimes people within
McDonald's might say in a jokey kind of way?
       A. It is a reference tool. I am not an operations guy.
I spend sometime in operations but I am not an operations
guy. Whenever I looked at that document I used it as a
reference tool. It is 800 pages, 900 pages and it is
something that if you are getting into an area where you
need some guidance, I would flip it up open and take a look
at whatever they had in there as I developed my plan on how
       to deal with something.

  Q. It is actually operations and training, so it covers your
       sphere of involvement?
       A. OK, go ahead, I will get you go for now. I will not
       try to clarify it.

  Q. It basically sets down the Company's view on things and the
way you want things carried out as well?
       A. No. It sets out various recommendations. There are
certain things in the Company that are very specific
specifications such as our food, etc., etc. Much of that
manual deals with providing models or recommended
approaches; often times there may be two or three or
whatever. It is a reference book to help people who need
some more information on dealing with the particular item.
       That is what it is.

  Q. You would not expect it to contain inaccurate information,
       though, would you?
       A. I would hope it would, but I bet you there are some
things that are probably not totally correct or have been
outdated because new procedures, new policies. I would
hope that overall if it is the latest volume it would be
       fairly accurate.

  Q. Perhaps you would like to get a copy of it?
       A. Sure. What is the reference?

  Q. Pink volume X.
       A. I have it. Where are you referring to?

  Q. On page 87 under "Retention of Crew".
       A. Is this the court's 87?

  Q. Yes.

MR. JUSTICE BELL: Yes, the stamp in the middle of the page.
