     1        reason we do rap sessions and the reason we have other
     2        communications, is to elicit the opinions of our crew so
     3        that we can, in fact, know if there are things we need to
     4        change or need to do better.  We are not perfect, no-one is
     5        perfect, but I think you have to give us some credit for
     6        really being very interested in putting plans together to
     7        make it better.

     9   Q.   And then taking no action because you do not believe the
    10        results?
    11        A.  That is totally untrue.

    13   Q.   Yes.  Also just going back to the question about receiving
    14        breaks when due, you said that you also know that most
    15        people do not know when their breaks are due and when they
    16        are not due.  Does that not concern you?
    17        A.  No, because you articulate to people but people work
    18        varying hours and they are not certain.  It is not
    19        something that most employees keep on the top of their
    20        head.  Their managers will only keep a schedule so that
    21        they know when people should go on breaks, but it is not
    22        something you expect your crew people to always remember or
    23        keep track of.  That is a management job, to keep track of
    24        that and make sure that people have their breaks
    25        appropriately.

    27   Q.   If they had set hours they would know when their breaks
    28        were, would they not?
    29        A.  I do not know.  How can I tell what someone else is
    30        going to know?

    32   Q.   And guaranteed conditions of employment?
    33        A.  Do we have a speech or is there a question?

    37   MR. JUSTICE BELL:  As I understand it, the way McDonald's
    38        operates, it does not really enable you nor, no doubt, you
    39        would say, can a crew member expect that this crew member
    40        will have a break at 10.40 in the morning, that the next
    41        one will have one at 10.45 and 10.50.  They are fitted in
    42        when a person is spared or covered in the course of
    43        sometime during the morning and sometime during the first
    44        half of the shift and sometime during the second half.  Is
    45        that the position?
    46        A.  It is, my Lord, but can I be more specific?

    48   Q.   Yes.
    49        A.  Generally speaking, when I was a manager, I would put a
    50        plan together.  I would know who was on what station, if 
    51        you will.  I would know who I would want to relieve a 
    52        person when they go on break.  I would anticipate my sales 
    53        volume as to the hours.  I would put together a tentative
    54        plan.  I could change it based upon -----

    56   Q.   So crew in your restaurant would know pretty well when they
    57        were likely to get it, would they, or not?
    58        A.  No, that would be something that I would keep.  They
    59        would know a range of time, generally within an hour span,
    60        but they would not know whether it would be 10.12 or 10.15,
