     4        you a question is because you are not allowed to respond.

     9   MR. JUSTICE BELL:  Do not say it now.  Say it later in the case

    12   MR. MORRIS (To the witness):  Then, if we go over the page under
    13        your heading entitled "Barometers", yes, under question
    14        41:  "I get paid for all hours worked", 77 per cent agreed,
    15        an average of 77 per cent agreed internationally; 23 per
    16        cent found they could not agree or they would disagree, but
    17        they get paid for all the hours worked.  Surely that is a
    18        fundamental ------
    19        A.  We are getting a distortion here.  I see that in
    20        England it is 82 per cent, 11 per cent do not really
    21        understand the question, apparently, and the rest, which is
    22        7 per cent, do not probably know whether they are or they
    23        are not.  It is not of concern to them.

    25   Q.   Mr. Stein, the question mark does not mean they do not
    26        understand the question.  It means they may not understand
    27        the question, they may not be sure or they may have passed
    28        over it for some reason.
    29        A.  Mmm.

    31   MR. JUSTICE BELL:  I reading that, Mr. Stein, as meaning that 80
    32        per cent have said that they do get paid for all their
    33        hours they work?
    34        A.  82 per cent agreed here in England.

    36   Q.   Yes.  11 per cent, there is some query over, whatever it
    37        may be?
    38        A.  Correct.

    40   Q.   But 7 per cent have said that they do not get paid for all
    41        the hours they have worked?
    42        A.  My Lord, I wish I could be that certain as to what they
    43        are saying when they disagree.  They may not be happy with
    44        the number of hours they are getting.  It could be a lot of
    45        different things.  When I have quizzed employees about
    46        surveys and their interpretation of questions, I wish it
    47        was as precise as being suggested right now.

    49        What I look at in this question, my Lord, is that if 82 per
    50        cent of any crew can agree that strongly on something like 
    51        that where I have never seen on any other survey by any 
    52        other company anything close to that, I am impressed with 
    53        the fact that, obviously, communications in this area and
    54        practices in this area are pretty good, are really very
    55        good.

    58        A.  So, I do not get black or white conclusions from any of
    59        this, my Lord.
