Day 144 - 28 Jun 95 - Page 42

       A. It could be a consideration, but you would then have to
go through a process. What England scored here is a
remarkable score, given the type of question this is. So,
in England, I would not be concerned about pay. 39, the
norm, if you are in or around that norm, if you will, my
Lord, and if it has not changed significantly over the
years, through rap sessions and other means, and your
surveys, there is fairness in there, I would not just take
a survey as the sole determiner. I would want to look
further and if there is a deviation from the norm, a
significant deviation, I would then look further.

MR. JUSTICE BELL: Let us break off there until 2 o'clock. Just
spend a minute or two during the next hour deciding what is
really vital you ask about that document including, sooner
rather than later, the point you originally in mind when
       you went to it.

Mr. Rampton I will give you the choice of dealing with your
matters in chambers at 2 o'clock or immediately after the
afternoon break, whichever you wish. Do you want to deal
       with it at 2 o'clock?

MR. RAMPTON: My Lord, I think I would like to deal with it at 2
       o'clock.

MR. JUSTICE BELL: Right. I will come back to court in
chambers at 2 o'clock and we will open the court as soon as
Mr. Rampton has dealt with his matter.

                       (Luncheon adjournment)

(For proceedings in chambers ref. separate transcript)

MR. JUSTICE BELL: Can we open the court officially Mr. Riley?

                    (Proceedings in open court)

                   STANLEY RICHARD STEIN, continued.
              Cross-examined by the Defendants, continued.

MR. MORRIS: Have you still got document H1 open?
       A. I believe so, the opinion surveys?

  Q. Yes. Just very briefly going through it, we note that in
the middle communications section, question No. 32: "Have
attended rap session in the last six months", 44 per cent
of respondents said that they would agree -----

MR. JUSTICE BELL: No, the international norm is said to be 44
       per cent.

MR. MORRIS: Sorry, yes. 44 per cent internationally are said
to agree with that statement. Does it concern you that
that may conflict strongly with your evidence that rap
sessions should be held at least within a three month
       period?

MR. RAMPTON: My Lord, I am afraid Mr. Morris is trying to make
apples into oranges. The frequency with which rap sessions
