Day 144 - 28 Jun 95 - Page 12
him on any account". Does it say something like that?
A. I have no knowledge of that. I cannot say if it did or
it did not. I do not have any specific knowledge of that.

Q. Did you discuss this at the time?
A. Yes, I recall that I was informed in discussions that a
low level person in the Personnel Department had sent out a
letter about not hiring union people, and that the German
company had rescinded it, and had moved the individual out
of the Personnel Department.

Q. When was the circular rescinded?
A. I was informed of that as soon as they became aware of
it.

Q. Is that as soon as the bad publicity accrued from this
memo?
A. I have no knowledge of any bad publicity.

Q. Herr Sperca, apparently, is the person who sent out the
memo, according to Mr. Copeland. It does not say if he
signed it; in fact, it does not even say the Chief of
Personnel did not sign it, Mr. Copeland does not say that.
He just said that the person who sent out the memo was a
person named Herr Sperca. Do you know what his position
was?
A. An administrator of some sort in the Personnel
Department but at a low level. He was not the Chief of
Personnel.

Q. Who signed the memo?
A. I do not know.

Q. You do not know who signed the memo?
A. I believe it was he because he was the only person
involved with that memo.

Q. You did not bother to find out at the time when you
investigated this thing who actually signed the memo?
A. I do not know if the memo was signed or not signed.
All I know is I was informed that he had sent a memo out.
It had been resigned and that he had been moved out of the
department.

Q. It would not matter who signed the memo really, would it?
A. Come now, sir!

Q. It came out of the Department?

MR. JUSTICE BELL: No, you are arguing the matter again now.

THE WITNESS: Come now, sir! It is very obvious that it matters
who sends out memos.

MR. MORRIS: This Herr Sperca who Mr. Copeland says sent out the
memo, he was not sacked, was he?
A. He was disciplined by moving him out of anything that
would involve Personnel matters.

Q. Yes, he moved into the Operations department?
