Day 144 - 28 Jun 95 - Page 09
you know of -----

MR. JUSTICE BELL: No, that does not follow. We must have had
dozens of occasions during this trial where I have said if
you begin a question with the word "so", it follows that
what you are putting logically follows from the witness's
previous answer. Mr. Stein has said he does not know.

MR. MORRIS: I think if the International Head of
Personnel -----

MR. JUSTICE BELL: Just ask a question, Mr. Morris, about it and
then address your comment to me later what conclusion you
say I should draw from it.

MR. MORRIS: Have you issued a memo or something to that effect
to all McDonald's restaurants in the world to say that
workers in your stores should have the right to distribute
union leaflets to each other, unless there is some very
good reason that I want to know about?
A. I have no recollection of ever issuing any memos
concerning this specific area to the world.

Q. Talking about memos, it has been admitted that the
Personnel Department in McDonald's Germany sent out a
circular in 1979 emphatically advising Managers not to hire
trade union members -- and you have heard about that, of
course?
A. It was not the Personnel Department. There was an
individual who sent out a memo that was rescinded
immediately, and the person was transferred out of
Personnel. I am aware of that, but I am not aware of
anything coming from the Human Resources Department of any
country.

MR. RAMPTON: My Lord, I am becoming very disturbed. Mr. Morris
has done it again. He has quoted selectively from
paragraph 13 of Mr. Copeland's statement. It must be read
as a whole. I know why Mr. Morris is doing it and I resent
it intensely. It is wholly improper.

MR. MORRIS: A memo was sent out by the Personnel Department in
Germany ------

MR. JUSTICE BELL: No, just pause a moment. Where are you
taking this from?

MR. MORRIS: I thought it was an admission, personally.

MR. JUSTICE BELL: Yes, in that case go to the admission and
make sure you are word perfect on the admission.

MR. MORRIS: If you remember, we amended our claim that it was
not the Chief of Personnel, it was the Personnel
Department, and McDonald's said that there would be no need
to call evidence on that because they had admitted -----

MR. JUSTICE BELL: Do not worry; find the admission and we will
get it right.
