Day 144 - 28 Jun 95 - Page 07

       in their stores?
       A. I can speak of the US. There are a set rules as to
soliciting or distribution of leaflets. They are
specifically set out by the National Labour Relations
Board. We have always been found to be handling that area
       correctly.

  Q. You said about the UK Company moving on a little bit at the
moment. No, I will just bring up -----

MR. JUSTICE BELL: When you say soliciting or distribution of
leaflets, do you mean in relation to union matters?
       A. And other matters as well, and under the NLRB would be
union matters, my Lord, but there are various state and
local ordinances dealing with the requirement that you have
to have these kinds of provisions in order to stop the
solicitation by insurance sales people, book sales people
or whatever. So, there are a variety of different laws, if
you will, my Lord, that govern this area, both federal,
       state and local.

MR. RAMPTON: My Lord, I am sorry I have taken a little bit of
time. I had to find Mr. Copeland's statement -- your
Lordship may wish me to come back to this in re-examination
-- but I do believe that there is element here of playing
to the gallery. I have had a look at the paragraph from
which Mr. Morris extracted that one sentence. It is not
representative of the sense of the paragraph.

MR. JUSTICE BELL: What is the reference?

MR. MORRIS: I am not bothered about the sense of the
paragraph. I am bothered about the rights of -----

MR. JUSTICE BELL: I am bothered about the sense of the
paragraph because it has been suggested that you have put
to a witness something in someone's statement which does
not actually reflect what the witness says.

MR. MORRIS: What it says -----

MR. JUSTICE BELL: Just listen to me.

MR. RAMPTON: May I invite your Lordship to look at it?

MR. JUSTICE BELL: Yes, we are going to look in a moment. The
reason we have to look at it is to see if that accusation
levelled at what you have done is accurate or not. If it
is not accurate, we can then put the bundle away; if it is
accurate, then Mr. Stein can look at the whole paragraph.
Is this in bundle yellow X?

MR. RAMPTON: My Lord, actually it is still in X. It will be
moved or may have been moved in your Lordship's case to
bundle XIII. My Lord, it is in your bundle X and it is at
tab 17 and the relevant paragraph is No. 12.

MR. MORRIS: We are happy for the whole paragraph to go on the
       record.
