Day 144 - 28 Jun 95 - Page 04
otherwise interfere or disturb the working employees". The
whole purpose of that is, is it not, Mr. Stein, to deter
crew members from even considering bothering discussing
unions with other crew members or trying to organise some
form of union activity?
A. No, it is not. It is meant to make sure that working
employees are not being bothered by other employees. It is
a matter of making sure that there is proper decorum in the
restaurant and that everything is flowing smoothly to serve
our customers.

Q. In this country, Mr. Nicholson has admitted that no overt
union activity would be allowed in the stores either by
crew members or by outside union people. Why are you
ashamed to admit that is also the case in America?
A. I am telling you what is the situation in the United
States. I am not ashamed of anything in the United States.

MR. JUSTICE BELL: I had not appreciated from what Mr. Stein had
said that he was ashamed to admit, so you had better just
ask him whether overt union activity would be allowed in
American stores; he may say that it is not.

MS. STEEL: Would overt union activity be allowed in your
stores?
A. I think I mentioned earlier that when our crew is in
their crew room they are free to do whatever they wish to
do. That is their -----

MR. JUSTICE BELL: Just listen. I will put the question,
Mr. Stein. Let us leave aside franchisees owner/operators
at the moment. In a McOpCo store in the United States,
would overt union activity be allowed?
A. In the crew room, yes, that is their time, my Lord.
That is specific -----

Q. That is involving crew members only?
A. When you say "crew members only"?

Q. No outsiders?
A. That is correct, my Lord. The rules in the United
States are very specific in this area and we are following
the rules of the National Labour Relations Board.

MS. STEEL: So if you do allow any negotiations, it is basically
because you are forced to under the law?
A. No, it is the legal requirement. We can comply with
all laws and that is the system in the United States.

Q. But, essentially, through the Crew Handbook you are
attempting to convey to the crew extremely successfully
that they are not allowed to either solicit for ---
A. Not at all.

Q. -- funds for unions or to encourage other crew members to
join?
A. There was a multiple of statements in what you just
said. I am not sure which one you want me to answer. It
sounded more like a statement than a question.
