3 MR. RAMPTON: My Lord, before cross-examination continues, there
4 is a matter which at some stage convenient to your
5 Lordship, either today or tomorrow, I should wish to
6 mention to your Lordship in chambers.

8 MR. JUSTICE BELL: Yes, very well. Let us see how we go with
9 Mr. Stein's cross-examination. In a search of my room
10 which was brought about because I am moving rooms at the
11 moment, I discovered copies of the New Earnings Survey,
12 part A for 1987 and for 1990. The 1990 gives rates of pay
13 in various occupations during the year up to 4th April
14 1990.

16 What I propose to do is put them on the side here. If
17 anyone wants to borrow them, please ask Mr. Riley, but let
18 Mr. Riley know who has the copies so that I know where they
19 are at any particular point in time. Please do not mark
20 them in any way in case photocopies have to be made in due
21 course.

23 MR. MORRIS: There is just one matter I want to bring up before
24 we continue our cross-examination. We have an outstanding
25 statement to serve. It is from the Director of Friends of
26 the Earth and it is regarding his discussions with
27 McDonald's in the 80s, about rainforests and the cattle
28 industry and the US labelling laws.

37 MR. MORRIS: Just to say, if our expert from America, if we
38 cannot afford to bring him over -- he is a Civil Evidence
39 Act notice statement anyway -- that Mr. Secret will be
40 called as an expert. He can give evidence in any case on
41 the negotiations with McDonald's, but he is also a general
42 expert on the subject.

47 MS. STEEL: Mr. Stein, union representatives agents, or what
48 Mr. Rampton called recruiting officers, would not be able
49 to come into stores and talk to crew members with the
50 purposes of trying to encourage them to join a union, would
51 they?
52 A. That is correct -- the same way as insurance salesmen
53 or people who are soliciting other things.

55 Q. Insurance salesmen are not likely to be invited in by the
56 crew, are they?
57 A. If we had a wide open rule there would probably be a
58 number of solicitations on a variety of subjects.
