Day 143 - 27 Jun 95 - Page 10
pleaded this is pleading No. 100.
A. Is this something I should be looking at?

Q. I can just tell you -- you do not have to get it out --
that McDonald's employees in Austria were in fear of losing
their jobs if they discussed joining a trade union.

MR. RAMPTON: No, my Lord. I am sorry. I have, your
Lordship, the same reservations as your Lordship about
Mr. Morris' ability to summarise things fairly. I would
ask that the witness be given the pleading because that is
not what it says.

MR. JUSTICE BELL: Yes. Mine seems to have disappeared. I have
it again now.

MR. MORRIS: I was only trying to save time.

MR. JUSTICE BELL: The abstracts of the pleading bundle; it has
a white spine.

THE WITNESS: Yes, I have it.

MR. MORRIS: It is No. 100, yes, on page 35?
A. OK.

Q. "The Austrian Federation of Labour in or around April 1986
publicised that McDonald's employees were in fear of losing
their jobs if they discussed joining a trade union, a
female employee made a public statement on this." Do you
know anything about the relations between the unions in
Austria and McDonald's?
A. No, I do not, absolutely nothing. To my knowledge,
there has not been any dispute or problems that I am aware
of.

Q. Have you visited Austria?
A. I was once in a resort town but not there on business.

Q. We will move on from that. I am going to come on to
something completely different for a moment: We are moving
away from the union issue for the moment, the case of
Mr. Faverty in the state of Oregon.

MR. JUSTICE BELL: Is this a particular?

MR. MORRIS: No. 84 is the pleading. There should be a document
in pink XIII, tab 57, I am informed. I do not know if you
have pink XIII, tab 57? Maybe we do not have to refer to
it but you can get it, if you want to.

MR. JUSTICE BELL: I suggest you start asking your questions and
if you need to refer Mr. Stein to a document, do so. In
fact, there are copious documents on this.

MR. MORRIS: Yes, I am not going to refer to hardly any of them.

MR. JUSTICE BELL: Let us see if we can do it without documents.

MR. MORRIS: I am trying to save time. Just to make sure I have
