Day 143 - 27 Jun 95 - Page 09
after the strike finished?
A. That the ground rules for how he and the union and
everyone were to deal with this matter had been laid down,
and that he should implement and follow through on not only
the letter but the spirit of what was suggested there.

Q. That situation remains the same up to now, does it? Apart
from there may be differences in terms of membership or
disputes, or whatever, the position, as far as you are
concerned, legally has not changed?
A. That is correct. The Commission's decision has carried
forward.

Q. Right. Are you aware that the Labour Board heard a
complaint from two union activists in 1985 in Dublin and
found in their favour when they complained they had been
victimized for trade union activities, in fact, sacked, are
you aware of that in 1985 in Ireland?
A. The labour dispute was long over by 1985.

Q. But there were still union activists in the stores and two
of them -----

MR. RAMPTON: No, my Lord. That is a question: Does he know
whether there were union activists in the stores?

MR. JUSTICE BELL: Ask if he knows because I have to say that
when you summarised the matter before -- I am not
suggesting you did it intentionally -- the summary you gave
was not what I would have read of the two decisions.
However that may be, I would be wary of summarising your
own interpretation of it.

MR. MORRIS: I was very careful in the way I put it.

MR. JUSTICE BELL: What I suggest is you ask Mr. Stein if he
knows anything about any activity before the Board,
tribunal, Commission, whatever it is called, in 1985? If
he does not, leave it there, because we have the rulings
and it maybe that Mr. Stein cannot advance the state of
knowledge, but you ask him. (To the witness): If you do
know anything about it, Mr. Stein, I am sure you will
answer Mr. Morris' questions.

MR. MORRIS (To the witness): Do you know anything about the
Labour Board decision against McDonald's over this matter?

MR. JUSTICE BELL: Do you know anything about decisions of the
Board or Commission -- I forget its proper title -- in or
around 1985?
A. My Lord, we talked about a picketing situation.

Q. No, it is not that; it is completely different.
A. Oh, OK.

Q. About six years after the one you have been giving evidence
of so far?
A. No, my Lord.

MR. MORRIS: I am going to move on from Ireland. We have
