Day 143 - 27 Jun 95 - Page 04

MR. MORRIS: This one is from the representative of the
McDonald's employees in Norway. Mr. Stein said he did not
have any personal knowledge.

MR. JUSTICE BELL: No.

MR. MORRIS: If he wants to look at it, in case there are any
questions tomorrow on it.

MR. JUSTICE BELL: We will leave that with Mr. Rampton.

MR. MORRIS: The next one is something that we only got about
three days ago which actually has a different fax date on
it, but this is not a statement. This is a printout of
food violations in US McDonald's restaurants. I did not
manage to get any more statements to serve today.

MR. RAMPTON: My Lord, I have not looked at the Norwegian
document. I am a little concerned that, as ever, it is
produced after the witness has finished his
evidence-in-chief or during cross-examination.
Fortunately, he knows nothing about Norway, so perhaps it
is does not matter.

I am rather more concerned about this new document -- I
have not looked at it -- that food violations, alleged food
violations, should be introduced at this stage, or sought
to be introduced at this stage, when all my food safety
witnesses have been and gone is, in my submission, quite
wrong and I would ask your Lordship to reject this
document.

MR. JUSTICE BELL: I will deal with that next week as one of the
matters in the interlocutory.

MR. MORRIS: This only came into our hands in the last two or
three days.

MR. JUSTICE BELL: No, we will have a proper argument about it
when we are arguing about a number of procedural matters
next week; by then I will have read it. I propose to
extend, unless you have anything to say, the same facility
to Mr. Rampton, Mr. Atkinson or Barlows with regard to
talking to Mr. Stein in relation to Mr. Jenson's statement,
if they wish, in the course of any adjournment.

MR. STANLEY RICHARD STEIN, recalled.
Cross-Examined by the Defendants, continued.

MR. MORRIS: Mr. Stein, while we are on the subject of
Philadelphia, there is one thing -- I do not know where it
has been put; is it our Civil Evidence Act notice --
Mr. Davidson who did this survey, could you just have a
look at that document?

MR. JUSTICE BELL: It is in pale blue II, please, and
section -- it is right at the back of that volume. Before
divider C there should be a statement of a Mr. Duncan or,
rather, a letter to Mr. Morris from Mr. Duncan.
