Day 142 - 26 Jun 95 - Page 28

starting salary, do you understand, the starting rate?
       A. OK, I did not understand "enhancements" from -----

  Q. Rises of 10, 15, or 20 cents an hour because of their
       performance as they develop ---
       A. Right.

  Q. -- then Mr. Morris says if you take all those factors into
account, the average starting rate for crew is probably at
or only a little above the federal minimum. What do you
say about that, if, in fact, you can answer the matter at
       all?
       A. What I am hearing him say, my Lord, is that it is
either at 4.25 or just slightly above at 4.30 or 4.35.
       I disagree with that.

  Q. A few cents above?
       A. Excuse me, my Lord?

  Q. A few cents above; at or a few cents above?
       A. I disagree with a few cents above.

MR. MORRIS: But within something like 20 or 30 cents above?
       A. I cannot say that; it could also be higher.

  Q. Even if it was a dollar above, it would still be near the
       minimum wage, would it not?
       A. I disagree with that, that a dollar above is near the
       minimum wage.

  Q. The fact is, is it not, Mr. Stein, that by any criteria
your employees start on extremely low wages, would you
       agree with that?
       A. I disagree.

  Q. And that it is only the -----

MR. JUSTICE BELL: You have put your point on this.

MR. MORRIS: Yes, I think we have put our case.
(To the witness): Do you have a bit of an understanding of
       trade unionism ---
       A. Yes, I do.

  Q. -- through your experience?
       A. Yes, I do.

  Q. No self-respecting trade unionist would accept wages like
that without negotiating for higher, would they?
       A. I totally disagree with that. You know, you talked
about Detroit, you talked about ACORN; why don't you take a
look at the agreement that they reached with Burger King
where they signed up a contract with Burger King that was
right at minimum wage, not above, right at minimum wage.
So, I suggest you take a look at your own agreements.

  Q. But once the principle is established of a union
negotiating in McDonald's, then the door is open for
workers to start increasing their collective strengths, is
       it not?
