Day 142 - 26 Jun 95 - Page 02

                                          Monday, 26th June 1995.

MR. MORRIS: We have just served a new witness statement
regarding the situation in New Zealand and trade unions.

  MR. JUSTICE BELL: In what?

MR. MORRIS: Regarding New Zealand and trade unions which I was
going to bring up today anyway. It is from the Industrial
Organiser of the Service Workers Union regarding their
agreements with McDonald's in New Zealand.

MR. RAMPTON: My Lord, I think I should be entitled to object to
this for a number of reasons; I am not going to do so. I
have glanced at the document. I am just looking to see if
there is anything about New Zealand in the abstract.
I cannot see anything at the moment. I could easily be
mistaken because I have only skimmed through it.

Plainly, we are not in a position -- have not been put in a
position -- where we can deal with anything that is in that
document. I have not had a chance to speak to Mr. Stein
about it, and plainly at the moment we have no evidence
from New Zealand for the reason, of course, that this takes
us by surprise. My Lord, on that basis, having said that,
I do not formally object to this, but I do ask that no
questions should be asked about it until I have had a
       sufficient opportunity to take instructions.

MR. JUSTICE BELL: Let me just read the letter.

MR. MORRIS: It is a statement to us for the purposes of this
       case done last night.

MR. JUSTICE BELL: How long did you anticipate your
cross-examination of Mr. Stein is likely to continue?

MR. MORRIS: We think we may finish on Thursday.

MR. JUSTICE BELL: Do not deal with New Zealand before
tomorrow. If Mr. Rampton wants to address me further about
this in the morning he can. But, as far as I am concerned,
he, Mr. Atkinson, or Mrs. Brinley-Codd or anyone from her
firm whom Mrs. Brinley-Codd chooses, can ask Mr. Stein
anything they wish about the letter. Let us leave it there
for the moment. If anyone wants to say anything more about
       it, they can do so.

For the time being I will add it to your Civil Evidence Act
       statements.

MR. MORRIS: Yes. The article which is referred to in the
documents was in our extra list of employment documents
served about six weeks, couple of months, ago. I cannot
remember what number it was but it is an article on labour
       notes.

MR. JUSTICE BELL: One thing I will say: Mr. Rampton has taken
no objection to this, so there we are. It is not to be
assumed on either side that parties can serve witness
