Day 141 - 23 Jun 95 - Page 29

       want to know what happened?

MR. JUSTICE BELL: You told us that -- I think Mr. Major said
much the same thing yesterday evening -- they had to get on
with it or that was going to be it?
       A. That is correct, my Lord.

MR. MORRIS: The UFW had not started a boycott at that stage?
       A. No, they had not. I had just received -- I had
received a telephone call from Cesar Chevez and he had
threatened it. My recollection is nothing had happened at
all at that point, other than his conversation with me.

  Q. When Cesar Chevez threatens a boycott, if he does it, he
       means things like picketing stores?
       A. Cesar Chevez is a little bit of tongue-in-cheek.
I have known him for sometime. He is deceased now. He and
I knew each other well and had frequent conversations, and
you never knew for sure whether or not he was really
pulling your leg or serious, but I told him I would look
into the matter because I was not aware of what was going
on, but I would look into the matter.

  Q. His union was capable of picketing the stores?
       A. Oh, yes.

  Q. Secondary picketing the stores?
       A. Yes, he was very capable of doing that. They had done
       that.

MR. JUSTICE BELL: His union had taken effective action in
various ways in other situations before 1983 or 1984?
       A. Not against McDonald's.

  Q. No, I am not suggesting that.
       A. Yes, against companies.

  Q. It proved an effective union?
       A. That is correct.

  Q. Under his leadership?
       A. I did not hear the last word?

  Q. Under his leadership?
       A. Yes, my Lord.

MR. MORRIS: I think we mentioned this before, that this is one
of the unions that would have potentially some designs on
       McDonald's?
       A. You have to separate the two unions that I think we are
starting to get confused with. The United Food and
Commercial Workers is a union that has an interest in
McDonald's, but the United Farm Workers, he is interested
-- maybe there may be an exception or two -- but he is
interested in agricultural workers, if you will, not
McDonald's workers. That is not what he is looking for.
So his threats had nothing to do with McDonald's stores,
except for secondary boycotts, to put pressure on Bruce
Church to do what he wanted to do with Bruce Church. It
had nothing to do with McDonald's employees whatsoever,
