Day 141 - 23 Jun 95 - Page 27

  Q. So the staff wanted to be represented by a union?
       A. What was told to us by the employees was that they did
not want to be represented by a union, but they were
concerned that they wanted to get back to work as quickly
as possible and they thought this other union might be able
to accelerate the process. That is why they went to the
       other union.

  Q. Since that day all the stores in Mexico have been unionised
       100 per cent?
       A. They are all union.

  Q. They are all union stores. Staff have not been beating
down the doors, whether it is a subsidiary or joint venture
partner, or whatever, demanding not to be in a union or
demanding that there is no union?
       A. There has been a very good Labour Relations
relationship. There are no issues whatsoever that I am
       aware of in Mexico.

  Q. So, effectively or objectively, CROC was successful in
ensuring that all McDonald's stores were unionised?
       A. If you will, I do not want to draw conclusions but CROC
was not successful. They transferred whatever rights they
had over to another union and said: "You take it". They
did not accomplish what they wanted. None of the employees
wanted them. They were about to lose an election in a big
time way, and they turned it over to a union that the
employees indicated they wanted. That is what CROC did.

MR. RAMPTON: My Lord, if we have left Mexico City or are
intending to leave Mexico City, I am not clear -- I do not
know if your Lordship is -- whether Mr. Morris is
challenging the veracity of the account -----

MR. JUSTICE BELL: I do not think you need ask because I can see
what is challenged and what is not.

MR. RAMPTON: My Lord, I was not clear whether it was or whether
it was not from the questions.

MR. JUSTICE BELL: It has not been.

MR. RAMPTON: If your Lordship says it has not been, then I need
not re-examine on it. That is all I need to know. I had
       thought there was something said.

MR. MORRIS: I am looking to see if there is anything else we
can get in before the end of the day.

MR. JUSTICE BELL: Sit down and see if you can fill up five
       minutes.

MR. RAMPTON: My Lord, it was only this passage that worried me
-- it is only because it affects my re-examination -- is
page 24, line 56, I think it is. Mr. Morris put this
question: "If your account is true about the intimidation
and the baseball bats of this other union, why was it, so
far as you could ascertain, that for three weeks when your
