Day 141 - 23 Jun 95 - Page 26

  Q. Until an agreement was made?
       A. Until the dispute was resolved.

  Q. The dispute was resolved. The union voluntarily passed on
their, what is the word ---
       A. Rights.

  Q. -- rights to another union?
       A. Yes.

  Q. That was all agreed amicably at the end?
       A. Yes, whatever their rights were, they passed it on to
       the other union.

  Q. You had meetings with the Under Secretary of Labour?
       A. Yes.

  Q. You told him that -----

MR. JUSTICE BELL: I know all this.

MR. MORRIS: No, I understand that.

MR. JUSTICE BELL: Try not to go through it again.

MR. MORRIS: Yes. I am sorry. I am just trying to build up to
a question. (To the witness): If your account is true
about the intimidation and the baseball bats, and all those
other matters, of this other union, why was it, as far as
you could ascertain, that for three weeks when your
property was taken over there was no action by the
       authorities ---
       A. With all -----

  Q. -- to clear them out?
       A. With all due respect for Mexico, when there is a labour
dispute they will not take action until there is an
election that finally determines the rights. It is a
practice. It is a policy. They just do not -- they will
not interfere. The same way that when I saw Police going
by and was concerned about the safety of people, I tried to
flag them down and they would not stop. They will not
interfere in a "labour matter", as they say. They will not
       get involved.

  Q. The reality is, is it not, Mr. Stein, that because
McDonald's had acted unlawfully or illegally in packing out
the store at the traditional time, then McDonald's did not
have a leg to stand on in this situation, in this dispute?
       A. Totally untrue.

  Q. The result of the dispute was that all the employees joined
this other union which CROC had abrogated their right to,
or passed on their right to, is that correct, specifically
       that other union?
       A. I think you are distorting what the facts are. To our
knowledge, what our employees did was when the facility was
shut down, they turned to another union to try to help them
end this matter with the CROC union.
