Day 141 - 23 Jun 95 - Page 23

MR. JUSTICE BELL: Are you saying that any particular figure
over 100 was normal, granted that they have different
capacities, or are you just saying, in effect, it would not
be unusual to find stores in Mexico employed more than 100
people?
A. It would not be unusual, my Lord.

MR. MORRIS: Do the part-time employees in that store or in
those what you say are -----
A. Could you start your question again?

Q. Sorry. Do part-time employees in Mexico average, in the
kind of store we are talking about, the same amount of
hours as part-time employees in America?
A. Generally, I would say, yes.

MR. RAMPTON: My Lord, I would like to say something if I may?
Normally, I do not say anything; normally your Lordship
allows (and, in my view, rightly, if I might respectfully
say so) a certain amount of ping-pong from the two
defendants, but we now have had a whole series of questions
really like a stychomuthia from a Greek drama. I am not
concerned about that, but I did detect there that Mr. Stein
might have been distracted by the way they bob up and down
alternately -- maybe he is not.

MR. JUSTICE BELL: Yes. Try to put a string together. If you
have a positive case on things, do put it rather than ask
to be given information, because I will assume that you
have nothing to put, that you are just trying to find
information. That may do you an injustice if you have a
positive case of your own to put. If it is your case that
a normal contingent would be about 60 or 70, positively put
it to the witness.

MR. MORRIS: All right. I put to you that for that kind of
store, for that kind of size, working at normal McDonald's
hours, as you have said, the normal ratio of full-time and
part-time, that store would have about 60 or 70 staff.
A. You could not possibly run that store with just 60 ,
not at all.

Q. If you give to us what you think the figure for that store
should approximately be?
A. I think for that store 125 to 150 would be about right.

Q. If that is the case , how many would you put on a
shift ---
A. Oh, God!

Q. -- would you expect to be on a shift? Sorry ------
A. To be very specific, I have never run a store ---

Q. OK.
A. -- with that many employees in the US. So, now you are
asking me to refer back to my Operations talent?

Q. No, I think you have already answered it, because you
accepted that there was something like -- would you accept
