Day 141 - 23 Jun 95 - Page 20

MR. JUSTICE BELL: If they are voting for the union, they do
literally vote with their feet, by leaving the store?
       A. Yes, my Lord. They do not necessarily leave the store,
       my Lord.

  Q. They stop work?
       A. They stop working.

MR. JUSTICE BELL: You have effectively had this from Mr. Stein
       the other day.

  MR. MORRIS: Yes.

MR. JUSTICE BELL: Why do you not just directly put your case to
       Mr. Stein, in so far as you challenge his account or do so;
and particularly in so far as you wish to suggest there is
more to it than he told me the other day, put that to him.

MR. MORRIS: The fact is, on that day, at six o'clock, there
were over 100, maybe over 150, McDonald's workers in
uniform, working in the store at six o'clock?
       A. I would agree with you -- and continuing to work
       thereafter, as they could.

  Q. What day of the week was this, do you remember?
       A. Oh, boy!

  Q. It was not a Saturday, was it?
       A. I do not believe so. But you are really asking me a
       lot for days.

  Q. That can be checked. These workers in uniform were crammed
into every available working space in the store?
       A. I would suggest there was a lot of people, a lot more
people on the floor than there would normally be, because,
to my knowledge, everyone was there; virtually everyone was
there on that day, which is not typical.

  Q. The management, as you said before, had hired 200 staff at
       this time?
       A. That is approximately correct.

  Q. You said something about because there were some sites for
       new stores?
       A. That is correct.

  Q. So I put it to you that, effectively, the management of
that store was trying to sabotage the traditional labour
process by packing the store out with people that clearly
were not working a normal, typical McDonald's shift?
       A. Untrue. I think I already told you that we have a
normally scheduled group. The employees on their own came
in and said they wanted all to be there. We were trying to
operate a normal store, a normal situation.

  Q. When McDonald's employees do act against the instructions
of the management, what action does management normally
       take?
       A. Management has to evaluate whether or not the employees
