Day 140 - 22 Jun 95 - Page 13
sent to these two gentlemen, he is talking to the top
management of the Company with his point of view.

MR. MORRIS: But as Head of Human Resources and personnel
matters, he would have responsibility for anything
affecting crew conditions and morale, or whatever, would he
not?
A. If you will notice a Don Horwitz, who CC'd on this, he
was the General Council, and my understanding, at least
when I came on board, was that this area was administered
by our General Council, not by John Cook.

You will notice, in fact, it says that he proposes
something. That suggests to me, further, that this was not
within his purview to make a decision; he was proposing to
the top management and to the department that handles it.

Q. He was not asking the lawyers, was he?
A. This was going to the lawyers, as well; it was going to
Don Horwitz.

Q. But he was not asking the lawyers to make a decision?
A. He was making a proposal.

MR. JUSTICE BELL: He was not making the decision himself, is
what Mr. Stein is -----

MR. MORRIS: He was not asking the lawyers to make a decision,
either, was he? He was saying it ought to be a policy
decision of the Corporation?
A. If this is his memo, he was sending this to these
people as a proposal.

Q. If we turn over the page -- sorry, not that. It is 76.
A. OK.

Q. I am not sure. Hold on a second. Maybe just read that to
yourself.
A. (Pause) I have read it.

Q. I think we looked at these before. It is part of letters
going to and from the Senior Deputy Labour Commissioner,
Brian Seal?
A. You are saying that I have looked at these before?

Q. No, no. Mr. Beavers went through these, anyway.

MR. JUSTICE BELL: Put to Mr. Stein only those things where you
think Mr. Stein can advance our fund of information.

MR. MORRIS: We recognise that as a letter from the Senior
Deputy Labour Commissioner, Brian Seal, April 2nd, 1973?
A. Excuse me?

MR. JUSTICE BELL: The letter there?
A. You see as much as I see.

Q. Sorry?
A. He or you see as much as I see.
