MR. MORRIS: I am just checking something. So when Mr. Kelly in
Detroit transferred people from outside his franchise
stores to cover for when people were attending a meeting or
a disco, then that would be an unusual event?
       A. No. We are talking about something totally different
now. I was talking about the transfer for normal everyday
business activities. I also testified, I am almost
positive -- in fact, I am positive -- when we talked about
Detroit, that for social events and other things when you
want to bring all of your employees together -- our
owner/operators like to do that -- they will then ask for
another crew to come in for two or three hours. That is a
different context. I was referring to the everyday
business needs and the fact that, as business fluctuates
within an organisation, they transfer people around
       frequently.

  Q. If we move on from Madrid, I want to deal with a brief
matter. It is, I think, pink XIV, tab 74.
       A. 74?

  Q. Yes. This is a memo by John Cook, your predecessor, in
terms of your present position; yes?
       A. Yes, it appears to be.

MR. JUSTICE BELL: I am sure I have been told, but I do not have
it immediately in mind: when did you actually take your
       position?
       A. I first started with McDonald's in June 1974.

  Q. I understand that, but -----
       A. To head up Human Resources?

  Q. You did, you joined for that -----
       A. No.

  Q. Because I had understood that John Cook hired you, and a
time came later when it was suggested you step,
figuratively speaking, into his shoes and became the Head
of Human Resources. When was that?
       A. 1981, my Lord.

MR. MORRIS: You had a lot of discussions with John Cook?
       A. Over the years, sure, I have had lots of discussions
       with John Cook.

  Q. You are aware of the controversy over the use of polygraph
       lie detector tests?
       A. You are going to have to tell me what controversy you
       are talking about.

MR. JUSTICE BELL: Forget the word "controversy". You were
aware that polygraph tests were used by some people within
       the McDonald's system?
       A. When I joined the Company? Yes, I was aware of that
       when I joined the Company.

MR. MORRIS: I am not going into any detail, because this was
dealt with by Mr. Beavers. But in terms of John Cook's
