  Q. But why should it be higher?
       A. I do not know. I would have to look at the difference
       between the figures.

  Q. I would have thought that if it is only the HSE, it would
be, if anything, bound to be lower.
       A. Well, probably not, my Lord, because a lot of the local
authority premises are comparative low risk premises
compared with the HSE ones which are all manufacturing
       industries.

  Q. But if this is all authorities, it must include the HSE?
       A. Yes, indeed, yes, indeed.

  Q. So these figures could not be less than the HSE only
       reporting, could they?
       A. Well, per 1,000 they would be because they include low
risk premises which are enforced by local authorities,
whereas if you take the figures purely and simply
administered by the HSE, they are manufacturing factories
which tend to have a higher accident rate.

  Q. But with McDonald's we are concerned with local
       authorities?
       A. Yes, indeed. If you remember, the question was one of
comparison yesterday with the food industry generally. We
were looking at different, if you like, rates of danger in
different types of premises. That was where the comparison
       was made.

MR. RAMPTON: My Lord, I think the evidence was -- I do not have
my transcript here, unfortunately -- the figure of 31 per
1,000 was for food manufacturing ---

MR. JUSTICE BELL: I understand that perfectly well, but -----

MR. RAMPTON: -- which does not give a separate figure in this
       that I could find.

MR. MORRIS: It does, food, drink, tobacco.

MR. RAMPTON: Quite, but food, tobacco and drink are all
       different things.

MR. JUSTICE BELL (To the witness): But depending upon which
category you choose as your comparable, and assuming that
you are accurate about the 31 in food manufacturing ---
       A. Yes.

  Q. -- the reporting rate varies between about 2.5 per 1,000?
       A. Yes.

  Q. Which would be the food, drink and tobacco manufacturing
       industries?
       A. Yes.

  MR. MORRIS: 25.

MR. JUSTICE BELL: 25 per 1,000. Then let me take the other:
