Day 131 - 06 Jun 95 - Page 62

       A. I am sorry, I do not have the reference, if you can
       give me the reference?

  Q. It is pink XIII, tab 55.
       A. Yes.

  Q. It is bundle number, at the bottom, 852 -- page 51 of the
       actual report.
       A. This is a report of the HSE's?

MR. JUSTICE BELL: Yes. That is the one you are being asked to
take home this evening. It is not as bad as it looks,
because the print only covers about half a page.

MR. MORRIS: In terms of performance, can you just explain what
performance standards are as they would relate to this
       investigation?
       A. Performance standards, as I understand it, for
McDonald's is where they have a set procedure to deal with
a particular task, and both are judged against the
performance standards. So they are making the point here
that there are a number of activities which have not got a
set procedure, presumably. It does not mean to say they
were not working properly, but it does mean to say there
was not a written procedure to put them in.

  Q. If a company was taking something seriously, they would be
expected to set a performance standard for ---
       A. Not necessarily so.

  Q. -- improvement?
       A. They are using performance standards as a comment and
as a standard, because that is a McDonald's term. The rest
of the industry does not use performance standards, as a
thing -- we might talk about safe systems of work, or
       whatever.

  Q. So what would be the equivalent, then, in the rest of
       industry?
       A. Standards of performance, SOPs, something along those
lines, safe systems of work, or whatever.

  Q. So, on page 852, they are concerned about performance
standards being inadequate or not existing, or expressed as
       such?
       A. On a very few activities, yes.

  Q. Applied to the use of potentially dangerous equipment?
       A. Yes.

  Q.   Or to pressure jet cleaners and large compaction equipment;
       safety during deliveries?
       A. Yes.

  Q. Preventing burns in the kitchen?
       A. Yes.

  Q. Safe working in cold stores?
       A. Yes.
