Day 131 - 06 Jun 95 - Page 61
MR. JUSTICE BELL: It would involve you looking at it
overnight.

MR. RAMPTON: I do not know if Mr. Purslow has one at home? If
not, perhaps he could be allowed to extract that one from
the bundle and put a treasury tag in it and take it home
with him?

MR. JUSTICE BELL: Perhaps you would make a mental note of
that? Do not mark it, because it will go back in the
witness bundle when you return it.

MR. RAMPTON: If he might be allowed to put yellow flags in.

MR. MORRIS: He could mark that one and that one could be
replaced.

THE WITNESS: I will make separates notes.

MR. JUSTICE BELL: By all means, make notes if you want. I will
say quite openly that the reason I do that is that it might
be (and I stress might) a helpful starting point for me in
relation to the question of health and safety at
McDonald's. I would not in the future want to treat it as
a useful starting point for what was going on in 1989 and
1990 if, in fact, significant changes had been made in 1990
and the interviews and observations which led to that
report.

MR. RAMPTON: There is of course a lot of comment about what
they found when they got there. What there is not a lot of
indication is when that was put in place. Mr. Purslow may
know.

MR. JUSTICE BELL: That is my point. (To the witness) Where
you see a comment -- and I am thinking of favourable
comments at the moment -- what I would like you to do, if
you can, is look for anything upon which they comment
favourably which you think may have come in since about the
middle of 1990; in other words, so that favourable comment
might not have been available if one was looking in the
autumn of 1989, for instance.
A. Certainly. I think I would be able to identify that,
because a lot of the McDonald's systems are up and running
and existing.

MR. JUSTICE BELL: If you read it through, either you will be
able to help or you will not, Mr. Purslow.

MR. MORRIS: Can you just explain what performance standards are
and how they are helpful in terms of taking safety
seriously?
A. I am sorry, what are you referring to there, first? Is
it performance -----

Q. Is there a particular role that -----
A. Performance of individual crew members, you mean?

Q. No, I mean in terms of particular jobs or particular
risks. If we look at page 852 -----
