3 MR. MORRIS: These 31 per 1,000 rate for food manufacturing, do
4 you know what the rate for catering industry -- these are
5 reported accidents, are they?
6 A. Yes. These are reportable accidents which have
7 actually been reported to the Health and Safety Executive.

9 Q. What are the categories which they use? They have the food
10 manufacturing category. We do not have the document in
11 front of us, but what are the other categories relevant to
12 McDonald's?
13 A. They are industry groupings. The Health and Safety
14 Executive work on what they call national industry
15 groupings and develop centres to look at it. So that you
16 have the food manufacturing industry; off the top of my
17 head, you have coal mining, you have metal working, and so
18 on and so forth.

20 Q. Are there any other categories that might relate to
21 McDonald's?
22 A. No.

25 A. The nearest one would be food manufacturing.

27 MR. JUSTICE BELL: So there is not a catering industry?
28 A. Well, catering industries -- the reportable accidents
29 in the catering industry are reported to local authorities,
30 my Lord. Now, although local authorities do a statistical
31 return to the Health and Safety Executive, I am not aware
32 of them putting that in the same sort of format that says:
33 "This is the total for the catering industry".

35 There is a great deal of concern about under-reporting in
36 the industry, as has already been stated. I have actually
37 talked to one of the senior inspectors from the Health and
38 Safety Executive about it comparatively recently. I am not
39 aware of comprehensive figures.

41 MR. MORRIS: So it is your understanding that in the hotel and
42 catering sector, the general level of under-reporting would
43 be something like one for every six?
44 A. That has been stated, yes.

46 Q. That is your opinion, that it seems a reasonable -----
47 A. I am going on other people's work, but that was stated
48 from the Health and Safety Executive and has been stated
49 nationally by the Institution of Environmental Health.

51 Q. The food manufacturing statistics of 31 per 1,000, are we
52 talking about generally factory work?
53 A. Yes. The bulk of people would be in factory work.
54 There may be associated place like warehouses, and so on,
55 but the bulk would be in factory work.

57 Q. So we would be talking about full-time jobs in general?
58 A. Well, there is a lot of part-time people in the
59 industry as well, because food manufacturing does tend to
