Day 131 - 06 Jun 95 - Page 39
Q. If you took a bit of time to think about it, or telephoned
someone, could you actually get the full names? Are they
HMSO publications?
A. Well, they are published by the Health and Safety
Executive, and the HMSO do not retail all their
publications these days.

Q. Will they have a reference number -- something of 1994, or
something like that?
A. They will have an ISBN number, yes.

MR. MORRIS: Do you know if Jill Barnes' department has those
documents which would be relevant to McDonald's?
A. I honestly do not know. She may well have.
I certainly have a Recipe for Safety at home, myself. It
is a document that I use widely, just to illustrate a point
when I am lecturing. So I do know its contents fairly
well.

MR. JUSTICE BELL: Can you get the ISB numbers?
A. Yes, I can endeavour to do so, my Lord.

Q. In any event, that is what you are relying on?
A. Yes, indeed.

MR. RAMPTON: My Lord, I would like to say something. I know
your Lordship does not thank me for continually grumbling,
but we have actually just had a ten-day holiday, and the
Defendants are not even now ready to cross-examine.

MR. JUSTICE BELL: I had not interpreted it as that way, because
there are respects in which Mr. Purslow has elaborated on
his statement. It may very well be that, for all I know,
if Mr. Morris and Ms. Steel started now they could
cross-examine perfectly well for half an hour. But it
seems to me it is not too much of indulgence to give them
an extra 75 minutes on the midday adjournment in the light
of the evidence which Mr. Purslow has actually given. What
is wrong with that? I can remember often enough, as
counsel, standing up and taking a bit of time to get into
my stride. You have no doubt had the feeling yourself,
Mr. Rampton.

MS. STEEL: You said 75 minutes, but it is 15.

MR. JUSTICE BELL: An extra 15 minutes on top of the hour.

(Luncheon Adjournment)

Cross-examined by the Defendants

MS. STEEL: Before Mr. Morris starts, I notice that someone came
back with some more copies of those reports, so is it
possible for me to have one again, because I handed mine --
I do not know whether to you or to the witness.

MR. RAMPTON: Someone came back with some copies of the report,
because they went and bought them. If they would like one
each, I will give it to Ms. Steel.
