Day 131 - 06 Jun 95 - Page 38

the British Road Federation, whatever it is, have different
points of view, in reducing it to 8. I saw a report on the
television last week where people were putting the
       arguments for and against.

THE WITNESS: It is just that, obviously, I am privy to research
done by various organisations, and I know that this is an
aspect that has been looked at by other organisations,
       without conclusion.

MR. JUSTICE BELL: I would not worry about British Rail, quite
       frankly.

MS. STEEL: If we know it is being to be disregarded, then that
is fine. But, otherwise, it was not mentioned in the
statement and, without seeing it or knowing how extensive
the survey was, or anything about the basis to be
       said -----

MR. JUSTICE BELL: At the end of the day, I am going to concern
myself with McDonald's, not British Rail.

MR. MORRIS: Is it possible to have a short break?

MR. JUSTICE BELL: You think that your cross-examination, your
combined cross-examination, will run into Thursday, do
you? I do not suppose it is going to make any difference
anyway. What I have in mind is, we could break off now and
resume at quarter to two, unless that inconveniences
anyone? Is that what you would like to?

MR. MORRIS: That is fine, yes.

MR. JUSTICE BELL: It will give you an extra 15 minutes on the
midday adjournment. Was there some other particular
       problem?

MR. MORRIS: There was just one other point I wanted to bring
up, which is, it was a document which I think is very
important, which is the health and safety statistics about
accidents in the catering industry and food manufacturing
industry that have been quoted, which I think are
       absolutely -----

MR. JUSTICE BELL: (To the witness) Do you know where they come
       from? Are they published?
       A. The accident rate in the food manufacturing industry
has certainly been recently published in an HSE publication
called Recipe for Safety, which highlighted the food
manufacturing industry specifically and quoted accident
rates. The accident rate for general industry will be
found in the annual report of the Health and Safety
       Executive.

  Q. Do you have copies of those?
       A. Not with me, my Lord.

  Q. But that is where they come from?
       A. That is where they come from, yes.
