Day 123 - 09 May 95 - Page 27
So, I mean, there is just a whole range of things
that -----

MR. JUSTICE BELL: Can I make a suggestion, Mr. Morris? Apart
from anything else you specifically want to put, if at the
end of the day you are going to say: "It would be quite
wrong to sack someone for this and McDonald's does it",
then you ought to put the misdemeanor or kind of
misdemeanor you have in mind. You may have some other
point but -----

MR. MORRIS: I am trying to compare -- what I am trying to say
is that it seems to me, without any argument, that there is
a lot of summary dismissal criteria for a crew person, on
paper anyway, which has come up in the case -- we do not
have to go into it now -- for various kinds of dishonesty.

What I am saying is, that applies to crew persons, but are
managers more or less expected to have the same level of
supervision or -- what I am saying is, does that ----

THE WITNESS: Managers are, I think, held to a higher standard.
They have greater responsibilities, so they are held to a
higher standard, if that is what you are ----

MR. MORRIS: Yes, that is what I am saying. Would that apply
the higher up you go in the organisation, the higher the
standards are expected to be?
A. I think that once you get to the point of being a
manager above, much more is expected of you. To say that
you know, a Vice President is held, that a Senior Vice
President is held to a higher level of honesty than a Vice
President, you know, I do not think that it bears --
I think we expect certain degree of -- well, we expect a
higher degree of honesty from all of them, certain
standards of ethics.

Q. Do the sanctions that apply to crew people also apply to
people in any position in the Company as you go up the
Company, or are there more sanctions against the people
doing the work at the bottom?
A. There are sanctions that are taken for a violation of
certain policies. We have published certain policies and
violation of those policies will result in dismissal,
suspension, or some other particular actions would be
taken.

Q. Can you explain what a policy means to the McDonald's
Corporation? What does that mean when you have a policy?
A. A policy would be something that is published to the
system, to a particular group in which we would expect that
group or the system to follow, to abide by.

Q. Is that different from a guideline?
A. That is different from a guideline, yes.

Q. Can you explain the difference?
A. A guideline would be a little less stringent, would
basically be a recommendation, a strong suggestion. We
provide many guidelines to our franchisees, to members of
