Day 122 - 05 May 95 - Page 32

putting a newspaper article to a witness who says he knows
nothing about it and then starting with a question "if".

MR. MORRIS: When you were Head of Personnel what was your
opinion as regards personnel welfare on whether breaks
should be paid or unpaid? What was your opinion as a
       policy maker?
       A. When I was Head of Personnel, I was in favour of staff
being paid for their breaks, but conditions change. I do
       not know what has led to this.  Conditions change;
       conditions in the industry change.

  Q. You are in favour of staff being paid for their breaks ---
       A. At that time it was appropriate.

  Q. -- because that is fair? It is fair, is it not?
       A. At that time it was appropriate and fair.

  Q. You think it is fair. There may have been some other
reason we do not know about.

MR. JUSTICE BELL: No, you have the answer you wanted; you do
       not have to underline it.

  MR. MORRIS: Yes.

MS. STEEL: Can I ask you something about something that appears
       in the Crew Handbook?

MR. JUSTICE BELL: Could I just say for everyone else's
reference that Mr. Stiles has reorganised my bundles
because my bundle V was getting too squashed. In my bundle
VI he has put everything from tab 21 onwards; tab 21 being
the FAWC Report. If that is thought to be unsatisfactory,
       I will change it back.

MR. RAMPTON: I am sorry, I am just asking whether it is.

MR. JUSTICE BELL: I would only say because in your No. 6 you
have only the one thin bundle, I think, Mr. Nicholson?

THE WITNESS: Yes. That is the only thing in there, my Lord.

MR. RAMPTON: My Lord, Mrs. Brinley-Codd tells me that what has
happened to your Lordship's bundles is wholly impermissible
for this reason, there is another file which will be empty
which Mr. Stiles will have which is a fat bundle V.

MR. JUSTICE BELL: Fatter than that? You see, that has 1 to 20
in it and it is absolutely virtually full.

MR. RAMPTON: I will withdraw that.

MR. JUSTICE BELL: If Mrs. Brinley-Codd does not mind, I will
ask Mr. Stiles to talk to her so that we will end up the
same. That is all. If Mrs. Brinley-Codd does not mind
       speaking to Mr. Stiles? Yes.

MS. STEEL: If you could get pink bundle XI, please?
       A. Yes.
