Day 122 - 05 May 95 - Page 31

  Q. You phase it in?
       A. No. It depends what prompted the change of conditions.

  Q. You reduce the working conditions?
       A. No, I never reduced the working conditions.

  Q. No, but the conditions when the unpaid breaks came in ---
       A. I have tried to tell you.

  Q. -- the conditions got worse for those who got unpaid
       breaks?
       A. I cannot tell you -- I do not know that it did. I do
not know why it was introduced and I cannot help you.

  Q. If we look at the Defendants' documents which was the
       additional documents we served?
       A. I do not think I have a copy of those. I have seen
them but I do not think I have a copy.

  Q. There is a file XV somewhere and it is document No. 3.

MR. RAMPTON: It is kingfisher bundle VI, my Lord.

MR. MORRIS: Tab No. 3 and it is an article from The Sun
       newspaper.
       A. Yes.

  Q. July 5th 1994?
       A. Yes, I have read it.

  Q. Did you hear about that at that time?
       A. No.

  Q. Let us have a look. The effect of that article, is it not
-- just the effect of what it says there -- is that staff
were not being paid for break times?
       A. I do not know anything about it.

  Q. No, I know you do not know anything about that particular
       incident ---
       A. Yes.

  Q. -- but, effectively, it is not against McDonald's policy
for staff not to get paid for their breaks, is it? That is
the policy now, breaks are unpaid?
       A. Whether they are unpaid in every restaurant or not, I
do not know. I do not know what the policy is now. You
really have to direct this kind of question to someone who
       is current.

MR. JUSTICE BELL: What is the point of asking Mr. Nicholson
about this article? He says he does not know anything
about it. When other witnesses come whom you think might
know something about it, you can ask them; they will either
know something about it and you can ask them further, or
they will say they know nothing about.

If you cannot get some confirmation from a McDonald's
witness, you may call evidence yourself, I do not know, and
you may do that in any event. But it is no use just
