Day 122 - 05 May 95 - Page 22
already given his answer to that. Just put it straight to
him.

MR. RAMPTON: My Lord, I think he has to go further than that
because the higher grades are salaried. He has got to put
to Mr. Nicholson that the salaried people are not paid if
they are not in the store.

MR. JUSTICE BELL: It is a perfectly normal phenomenon, is it
not, that people do, from time to time, the job of someone
who is higher in the hierarchy than they do? It may be
through management necessity; it may be to give them a
chance to get the experience; maybe to get a chance to see
how they do it. You are suggesting, and this is what you
ought to put, that in McDonald's it is done do save money
on salaries/wages.

MR. MORRIS: It is one -----
A. My answer to that is no ----

MR. MORRIS: It is one of saving money, is it not, that if you
can have somebody on a lower pay scale, carrying out the
functions of somebody on a higher grade who has been
trained for that purpose, then it is just a fact of life it
will save the company money, will it not?
A. It is a fact that that could be so. We do not use it
that way.

Q. One final question on that point. The closes that are
done, when you close a store, that is a very responsible
job?
A. It is part of running the restaurant.

Q. Yes?
A. Everything in the restaurant is a responsible job.

Q. Cleaning electrical equipment, ensuring everything is ---
A. Hygienic.

Q. OK for the next day?
A. Yes.

Q. What grade of management would that be expected to be done
by?
A. Shift Running Manager.

Q. A Shift Running Manager. Is that one step up from Floor
Manager?
A. No Shift Running Manager -- it could be Floor Manager,
trainee Manager a second assistant, a first assistant, it
could be the Manager. They all take their turns in doing
closes. I will extract from that "trainee Manager"; I do
not think they would give that to a trainee Manager.

MR. JUSTICE BELL: Ms. Steel was quite happy we continue, was
she?

MR. MORRIS: Yes, she has just gone out for a couple of
minutes. I will ask a couple of questions in the
meanwhile. One thing, I did read somewhere, but I cannot
