Day 122 - 05 May 95 - Page 19
MR. RAMPTON: I will leave it, my Lord.

MS. STEEL: The phrase "tampered with" is vastly different to
"carry out repairs on", or -----
A. I disagree entirely. It means you do not touch them.

Q. Why does it not say "electrical installations and equipment
must not be touched"?
A. I was not the author of this report, I have no idea.
But that is what it says: "It must not be tampered with"
and I interpret that as meaning it must not be touched.

Q. "Tampered with" implies interference or poking around, or
something like that?
A. That is right.

Q. Which is very different?
A. That is what you do when you change a plug, you tamper
with..

Q. No, it is very different from changing a plug?
A. That is interpretation.

Q. Did not you think it was important to have, in a company
document to crew members, something that was not widely
open to being vastly differently interpreted?
A. In my opinion that sentence deals with it adequately.

Q. In the longer statement that you made you said: "It is
correct that managers are trained as part of their
management training to control controllable expenses. For
example, labour, the maintenance and repair of building and
equipment, promotions, food and paper costs etc." So as
well controlling labour, the management are expected to
control promotions, yes?
A. I said that yesterday.

Q. In order to cut costs, the company tries to limit the
number of people who can progress to a higher grade?
A. No.

Q. That contradicts the answer you gave previously, does it
not?
A. No.

Q. No? Can you explain the difference?

MR. JUSTICE BELL: I do not think it does necessarily at all.
You are being more specific about steps which are taken to
cut costs; one can think of any number of ways. I think
Mr. Nicholson might have drawn the inference, but you put
him right if he is wrong, that you were intimating it does
so unfairly, that people who ought to progress by virtue of
their work performance are held back in order to save
money.

MS. STEEL: Mr. Nicholson, can you explain the difference
between the two?

MR. JUSTICE BELL: He does not have to because I can see one
