Day 122 - 05 May 95 - Page 12

MR. RAMPTON: I think your Lordship is entitled to an
explanation. It might shorten things if Mrs. Brinley-Codd
would like to have five minutes with me. I know nothing of
the chronology, when, what and why things were taken out,
so it might help if I got those instructions now. It is a
matter for your Lordship, of course.

MR. JUSTICE BELL: Are you proposing to deal with any more of
       this?

  MS. STEEL: Not right now.

MR. JUSTICE BELL: We will have the five-minute break now.
Mr. Rampton can then give an explanation if he wishes to.
We will then carry on. We will not have a further break
       this morning.

MS. STEEL: Firstly, could the witness be reminded not to talk
       to -----

MR. JUSTICE BELL: There is no question of talking to
Mr. Nicholson. Mr. Rampton wants to speak to
       Mrs. Brinley-Codd.

MS. STEEL: The other thing is, would it be possible for
Mr. Nicholson to remain outside while the explanation is
being given in case we want to ask further questions as a
result of what is being said?

MR. RAMPTON: I have no objection.

MR. JUSTICE BELL: I cannot see any point in it because at the
moment you have not suggested any sinister reason for doing
it. I cannot see one when there is one relatively, what
might be thought to be one relatively, minor change.
Although I appreciate you say it may have significance,
I am not at the moment inclined to suppose Mr. Nicholson is
not telling the truth when he said he did miss the
difference in one line, and where the other changes which
are made are extractions from his statement. So you have
more information than, for instance, I have got, rather
than less. But if you do have a sinister motive, which you
want to argue to me in due course, then put it to
Mr. Nicholson when we come back.

It is no reflection on you, Mr. Nicholson, but when we do
come back, would you mind just waiting outside until you
       are called back?

  THE WITNESS: Not at all.

                           (Short Adjournment)

MR. RAMPTON: My Lord, I can take this a certain distance. I
cannot go all the way yet, but your Lordship may not think
it necessary I should. Can I go back to the beginning?

  MR. JUSTICE BELL: Yes.
