Day 122 - 05 May 95 - Page 03

MS. STEEL: No, it is the first one then.

MR. JUSTICE BELL: Paragraph 21?

MS. STEEL: Paragraph 21, a sentence has been cut out of that
which reads: "We have a fully equipped gymnasium at Head
Office and two luxury holiday apartments, one in the
Algarve and one in the Costa Del Sol, which are used for
rewarding high performers". That is about the salaried
staff.

MR. RAMPTON: My Lord, that is in my version, so I do not know
what has happened. I have exactly the same words as
Ms. Steel.

MR. JUSTICE BELL: I think you possibly have -- this is
paragraph 21 on page 9 of the statement, is it?

MS. STEEL: Yes.

MR. RAMPTON: My Lord, I am not understanding what the point
is? Ms. Steel appears to have a statement which is the
same as mine.

MR. JUSTICE BELL: It is not the same as mine which is what is
in the bundle.

MR. RAMPTON: I understand that.

MS. STEEL: It is not the same as the one that is in the trial
bundle.

MR. RAMPTON: My Lord, that does not matter. If the Defendants
have the same statement as I have, then they are at no
disadvantage.

MS. STEEL: It does matter because a different statement was put
in the trial bundles without notification. This was the
one we were working from. It was yesterday, because I had
some notes from Simon Alenny who had commented on
Mr. Nicholson's statement.

MR. JUSTICE BELL: You carry on with your submission. Tell me
what other differences are there?

MS. STEEL: After paragraph 21 there is a whole paragraph that
has been cut out which reads: "Thus, the pay conditions
for all McDonald's employees is comparable to and usually
often surpasses that of our competitors and exceeds on
almost all occasions the minimum wage". The whole of that
has been cut out. The paragraphs are actually numbered
differently in the two statements from then on, so it gets
a bit more complicated.

MR. JUSTICE BELL: Yes, but that is a consequence of missing a
paragraph out, is it not.

MS. STEEL: Yes. If you turn to paragraph 25 of the statement
that you have after: "Nonetheless, staff are discouraged
