witness. None of the McDonald's companies, either the
First Plaintiff or the Second Plaintiff, or the McDonald's
Development Corporation was a party to this.

MS. STEEL: McDonald's Ireland, Pantry Franchise, known as
       McDonald's in Ireland.

MR. JUSTICE BELL: I am sorry, I have told you I am not going to
say it again. Pantry Franchise Ireland Limited is not in
fact McDonald's. It obviously ran a restaurant, taking
advantage of the McDonald's brands name and the McDonald's
system but they are not the same thing.

MS. STEEL: Mr. Nicholson said that it ran all the Irish stores,
and it was not allowed to run any other kinds of stores.

MR. JUSTICE BELL: He said it serviced them. He said the
McDonald's companies serviced the franchisee, which is a
separate company which is running the restaurant. You may
have a good point at the end of the day when you have more
evidence about it, but I do not think Mr. Nicholson can
       help on it.

MS. STEEL: Do Pantry Franchise run all the McDonald's stores in
       Ireland?
       A. No.

  Q. Did they in 1985?
       A. I am trying to think. They ran all the restaurants in
Dublin. I am not quite sure when the first one opened in
Cork. That is a different company.

  Q. How many were there in Dublin? I believe there were four?
       A. No.

  Q. There are now.
       A. Eight, I think, at that time.

MR. MORRIS: It is probably time to finish but I do not think it
       is -----

MR. JUSTICE BELL: Correct me if I am wrong, I thought you had a
Civil Evidence Act statement from Mr. McCann, who is
outside the jurisdiction, which sets out his whole account
       of what happened.

MR. MORRIS: Yes, it was on Mr. McCann and Mr. O'Brien.

MR. JUSTICE BELL: I think it is Mr. McCann, because there is
another Mr. Mc-someone you have got.

MR. MORRIS: Yes, I think the Plaintiffs have a problem on the
the status of their franchisees, which is up to them to
sort out. Because throughout this case when they say
       McDonald's, McDonald's does this, McDonald's is this,
McDonald's have these policies, produce these products,
they are talking about all of their restaurants in the
system throughout the world. When they talk about the
number of McDonald's restaurants, that is what they are
referring to, that is what the case is about. If they want
