Day 120 - 03 May 95 - Page 25

MR. MORRIS: Right. (To the witness): That is just a general
       prohibition?
       A. Yes.

  Q. But, in fact, that can be waived in the cases of collection
       for charity; is that correct?
       A. It says "basic guidelines". If it is an authorised
collection, and we do have authorised collections for
children's charities, they can be collected.

  Q. On that page, 130, it says: "(b) Because your time card
records your own hours worked, you must only use your own
card; you must never use another employee's time card"?
       A. Can you just direct me again?

MR. JUSTICE BELL: It is page 130 in tab 3.
       A. Thank you, my Lord. It is (b): "Because your time
card records your own hours worked, you must only use your
       own card". Yes.

MR. MORRIS: "You must never use another employee's time card".
       A. No.

  Q. If you did use another employee's time card, that
transgresses one of these clauses. What happens, is that a
serious offence, the use of another -----
       A. I think if you go back to the Gross Discipline, the
discipline you will find that that is one of the specific
       things, using someone else's -----

MR. RAMPTON: My Lord, it is (b) on page 46.

MR. JUSTICE BELL: While we are on 146, K at the top, posting,
et cetera, notices on notice boards without authorisation
is an example of misconduct which may lead to disciplinary
       action being taken.

  MR. MORRIS: Right.

MR. JUSTICE BELL: But, in any event, if you do something in
contravention of a company rule, I suppose that is
       disobedience ---
       A. Of course it is.

  Q. -- or failure to obey instructions and so on, so will come
       in under capital paragraph A?
       A. Indeed it could do; it would depend upon the severity.

MR. MORRIS: Yes. So, all I am saying is the guidelines and
responsibilities, they are not just there for the fun of
       it, they are rules?
       A. Yes, they are. They are guidelines that that is -----

  Q. That have to be followed?
       A. They should be followed, yes.

  Q. And would lead to discipline if you transgressed?
       A. Almost certainly.
