Day 119 - 02 May 95 - Page 28

without calling the witness. If you can say: "Oh, well,
look, he is a manager for McDonald's and we ought not to be
expected to put him in the witness box; here is his
statement, that ought to be enough", put in colloquial
language. Anyway, let us move on now.

MS. STEEL: I found the reference to one or two things in there
that "surprised" Mr. Nicholson. It is on page 11, line
       29. You said one of those things was the way the rap
sessions were held surprised you. Was there anything else
that you wanted to say that surprised you about the video?
       A. No, not really. The one that stood out -- first of
all, I have a feeling that Paul Hickling is in direct chain
of command above that restaurant. That would be unusual.
Secondly, it lacked the fervour that you generally find in
a rap session but, as I made the point, I feel, perhaps,
the intrusion of the cameras probably affected the crew
       people.

  Q. But in terms of the video as a whole, that was the only
thing that stood out in your mind as being surprising?
       A. And the fact that I felt that, certainly, the opening
sequence and, perhaps, once or twice afterwards when it
showed a shot down the behind the counter of the restaurant
the film had been slighted speeded up; that people were
moving faster than I would have anticipated anybody would.
I mean, that is all, otherwise it was a film of life in the
       Strand and Croydon.

  Q. McDonald's?
       A. Yes. As I say, I recognise ever so many of the staff
       there.

MR. MORRIS: Working through your evidence-in-chief, you said
that for the under 18 year-olds working illegal hours, or
something, that you did not know of it. You were asked how
often has it been broken in practice and you said you do
       not know of it.
       A. No. May I just correct you? I know of the three
       admitted cases.

  Q. Right.
       A. Simply because -- they happened before my time, I was
       not aware of them.

  Q. The prosecutions?
       A. Yes, that is right, but since that time I have no
knowledge of any infringements of the regulations.

  Q. You know there has been an admission, do you not --
I cannot recall where it is now -- about two employees that
worked -- if the Plaintiffs could help me? There has been
an admission, I believe, about something we came across by
chance regarding the two employees from a particular
store. Harrison somebody of other -- let me see if I can
       find the quote.

MR. JUSTICE BELL: It is 2nd November 1982 -- is that the one?

MR. MORRIS: No, not these ones they were prosecuted for. Maybe
