Day 119 - 02 May 95 - Page 15
of paid employment -- and they never will.

MS. STEEL: It is just a shame we cannot talk about it.

MR. MORRIS: It is an arguable point.

MR. JUSTICE BELL: Complaining about the level of one's pay is
one of those, but that is not to take away from what
evidence you may have that pay is low. I am just saying
that I am not going to pay too much attention to
individual's reactions about whether they think they are
being paid enough or not.

MR. MORRIS: Yes. (To the witness): You said the subject
matter and the comments were typical. What about the
complaints about hours worked being under recorded?
A. I -----

Q. You heard that many times before?
A. No. I would be concerned. If that came up in a rap
session, I would ask for enquiries to be made. I must say,
however, unless you can direct me to it there, I lost some
of that conversation. The sound was not all that good,
I think. I did hear them say that they -- someone said
they had been docked six hours or something.

MR. JUSTICE BELL: It was much more than that. Someone went as
far as saying they worked about 80 or 90 and had only being
paid for 60 and had worked six or eight hours overtime and
only been paid about an hour.

MS. STEEL: It is on page 18.

THE WITNESS: That is totally unacceptable. If I got that out
of a rap session, I would have had enquiries made into it
immediately.

MR. RAMPTON: The Defendants may be falling into the trap, I do
not know, of thinking what those people said on this
programme is evidence. It is not.

MR. JUSTICE BELL: I do not think they consider that that is
so. As I understand it, what you are seeing is whether
Mr. Nicholson will accept some things so that they do
become evidence.

MR. MORRIS (To the witness): They said they only got a pay rise
every six months after getting their first star or
something?
A. That is wrong.

Q. One person said that, I think?
A. Yes, she was, if I remember rightly, a new recruit.
That would be wrong.

Q. So the performance review every six months, is it?
A. No, the performance review is every two months. Every
other performance review is linked to a pay review, so you
get three pay reviews per year.
