     3   MS. STEEL:  It is just a shame we cannot talk about it.

     5   MR. MORRIS:  It is an arguable point.

     7   MR. JUSTICE BELL:  Complaining about the level of one's pay is
     8        one of those, but that is not to take away from what
     9        evidence you may have that pay is low.  I am just saying
    10        that I am not going to pay too much attention to
    11        individual's reactions about whether they think they are
    12        being paid enough or not.

    14   MR. MORRIS:  Yes.  (To the witness):  You said the subject
    15        matter and the comments were typical.  What about the
    16        complaints about hours worked being under recorded?
    17        A.  I -----

    19   Q.   You heard that many times before?
    20        A.  No.  I would be concerned.  If that came up in a rap
    21        session, I would ask for enquiries to be made.  I must say,
    22        however, unless you can direct me to it there, I lost some
    23        of that conversation.  The sound was not all that good,
    24        I think.  I did hear them say that they -- someone said
    25        they had been docked six hours or something.

    27   MR. JUSTICE BELL:  It was much more than that.  Someone went as
    28        far as saying they worked about 80 or 90 and had only being
    29        paid for 60 and had worked six or eight hours overtime and
    30        only been paid about an hour.

    32   MS. STEEL:  It is on page 18.

    34   THE WITNESS:  That is totally unacceptable.  If I got that out
    35        of a rap session, I would have had enquiries made into it
    36        immediately.

    38   MR. RAMPTON:  The Defendants may be falling into the trap, I do
    39        not know, of thinking what those people said on this
    40        programme is evidence.  It is not.

    42   MR. JUSTICE BELL:  I do not think they consider that that is
    43        so.  As I understand it, what you are seeing is whether
    44        Mr. Nicholson will accept some things so that they do
    45        become evidence.

    47   MR. MORRIS (To the witness):  They said they only got a pay rise
    48        every six months after getting their first star or
    49        something?
    50        A.  That is wrong.

    52   Q.   One person said that, I think? 
    53        A.  Yes, she was, if I remember rightly, a new recruit.
    54        That would be wrong.

    56   Q.   So the performance review every six months, is it?
    57        A.  No, the performance review is every two months.  Every
    58        other performance review is linked to a pay review, so you
    59        get three pay reviews per year.
