Day 119 - 02 May 95 - Page 11

speeded up a little, which we can ask the film maker about?
       A. I thought on both occasions when we saw the close up
behind the counter, clearly, that was lunch-time because of
the volume of people working there. I honestly thought
that that had been slightly, not a great deal, but slightly
speeded up to give an even bigger impression of hustle.
That was my impression. I could be wrong but that was my
       reaction.

MS. STEEL: Can I just make an observation? We have asked
Mr. Rampton not to make comments out loud previously.
Whilst that shot of the store was being shown, that was
actually what Mr. Rampton said, "That sequence has been
speeded up". I really think he ought to make more of an
effort to control himself rather than giving the witnesses
       ideas.

MR. RAMPTON: My Lord, I whispered to Mrs. Brinley-Codd that
that was my impression. I think the right question to ask
Mr. Nicholson, if I may say so ------

MR. MORRIS: I am asking the questions.

MR. RAMPTON: An objection has been made, Mr. Morris, and I
shall answer it. The right question to ask Mr. Nicholson
is whether he took that opinion from me or from his own
       observation.

MS. STEEL: There is also the question of -- this is a request
-- I know that Mr. Rampton is capable of whispering things
quietly to Mrs. Brinley-Codd. There are a number of
occasions when he says things loud enough for other people
to hear. We consider that it is deliberate.

MR. JUSTICE BELL: I did not actually hear it myself. It is
obviously essential that people have to keep their voices
down so they communicate only with those they are
addressing. I am certainly not going to reach a conclusion
that Mr. Rampton, if he did say that, said that with a view
to prompting Mr. Nicholson. But you can ask the question
Mr. Rampton suggested, if you want to. If you are going to
suggest that Mr. Nicholson gave that answer because of
something Mr. Rampton said, you should put it to him.

MR. MORRIS (To the witness): Did you give that answer because
of something that Mr. Rampton said?
       A. I honestly did not. I know that is the kind of answer
you would expect me to give, but I really did not hear
anything whispered by Mr. Rampton to Mrs. Brinley-Codd.

  Q. Apart from those points which you said about the speed of
the film, those two points, was the filming an authentic --
it is just a basic, fundamental question before we get on
to whether that is the same in other stores.

MR. JUSTICE BELL: Can we take it this way? Just pause for a
moment because I really think you have to put what you are
aiming at and ask whether that is accurate, but I assume
you have no reason whatsoever to doubt that that was filmed
in a McDonald's store or stores; that, for instance, it was
