1 MR. JUSTICE BELL: What I suggest is, do not refer to those

6 MR. JUSTICE BELL: We can pick it up in the morning, if need
7 be. Mr. Rampton or Mrs. Brinley-Codd can talk to
8 Mr. Nicholson about them overnight. Mr. Nicholson, if he
9 has not yet seen them, can look at them overnight. We will
10 see whether they are matters which, having looked at, he
11 can deal with of his own knowledge or whether he has to
12 make some further enquiry.

14 MR. MORRIS: If I can just say that I think Mr. Rampton's
15 speech, if you can call it that, was basically directed at
16 times when we do find cross-examination confusing and
17 difficult, which is inevitable in a case of this complexity
18 and length and especially when there is a new issue. There
19 is an enormous mass of documents and an enormous breadth of
20 issues within this issue. We would hope that the court
21 would be understanding that it is not always easy to -----

23 MR. JUSTICE BELL: I do not even know what is in there, so I am
24 not going to make any further comment about it. What I ask
25 you to do now, and Ms. Steel, is start your
26 cross-examination of Mr. Nicholson, and steer clear of
27 anything which requires reference to any of these documents
28 until further notice. If need be, we can pick it up in the
29 morning when I have had a chance to look at it and
30 Mr. Rampton has had a further chance to look at at it and
31 Mr. Nicholson has had a chance to look at the documents as
32 well.

34 MS. STEEL: I wanted to say something else as well. Last night
35 my computer conked out. I have got various notes on there
36 about where cross-referencing and things like that, so
37 I may have a problem with cross-references. I did not have
38 questions on there.

43 with cross-referencing because that is where all my notes
