1 MS. STEEL: The visit had several purposes. Firstly, we met
2 with the American lawyer that had been our attorney, that
3 had been making the discovery application, and we discussed
4 various matters with him. We also spoke to a number of
5 witnesses of ours and new witnesses, whose statements we
6 will be serving shortly.

8 We did not attend demonstrations for five or six days. In
9 the time we were over there we attended demonstrations on
10 one day. The rest of the time was either holiday or
11 working on the case, either with the attorney or with
12 prospective witnesses. We have prepared some questions for
13 Mr. Nicholson, and we had before as well. We did spend
14 time during the Easter break reading documents and
15 preparing questions. Dave is going to explain what he said
16 on Thursday.

18 MR. JUSTICE BELL: What about the documents?

20 MR. MORRIS: The documents, I spoke to Mrs. Brinley-Codd on the
21 phone, and said that I was having difficulty completing
22 them by the end of Friday. I worked all day Friday on
23 them. She said it would be fine to send them express post.
24 I posted them at 4 o'clock, or something, on the Friday
25 express post. We were left with the impression it was a
26 guaranteed one day delivery. So she said that would be
27 fine.

29 Also what I said about the questions to Mr. Nicholson were
30 about the documents as you have suggested. That was what
31 I meant. I had not prepared specific questions about
32 particular documents, what they meant. But I just do not
33 know what the purpose of Mr. Rampton's assault on us is at
34 the beginning of our section of the case.

36 MR. JUSTICE BELL: Stop there because I want you to start and
37 get on with your cross-examination. I think what he is
38 really saying is if it turns out during the
39 cross-examination that a lot of time has been taken and
40 there is no direction, then he will invite me to suggest
41 that you have not been using the time you should have done
42 to prepare, but I am certainly not going to prejudge it
43 like that. We will see the way your cross-examination
44 goes. I hope it is directed at the issues and you get
45 through it with all due economy. But that is why I asked
46 about the documents. What do the documents concern?

50 MR. JUSTICE BELL: What I am minded to say at the moment is you
51 get on with your cross-examination now with Mr. Nicholson
52 and Ms. Steel takes such part as she wishes to take in the
53 cross-examination with Mr. Nicholson. Do not use any of
54 these documents for the time being.

56 MR. MORRIS: Yes. I did say on Thursday, whenever it was, that
57 of course Mr. Nicholson should have a chance to see the
58 documents and it was in our interests that they got them as
59 soon as possible.
