3 MR. RAMPTON: My Lord, before I call Mr. Nicholson, there are a
4 couple of things, administrative matters, I would like to
5 attend to, if I may? The first is to remind your Lordship
6 that on the last day we sat, which was 6th April, at the
7 end of that day your Lordship said to the Defendants that
8 what your Lordship would like them to do is when they came
9 back at 2 o'clock on Wednesday, 26th, that is today, bring
10 with them a list of those witnesses who have indicated that
11 they are going to come to court to give evidence. That,
12 your Lordship said, should happen before Mr. Nicholson gave
13 his evidence. That is the Defendants' employment
14 witnesses.

16 MR. JUSTICE BELL: What is the position, Mr. Morris? I think
17 you were, essentially, dealing with it, were you not?

19 MR. MORRIS: Yes. The news is that we have had so far seven
20 replies. The only person that indicated that he does not
21 wish to attend, although of course we have the right to
22 subpoena him, is Dave Townsend from Swindon. There is
23 another witness from the Swindon store.

25 MR. JUSTICE BELL: So that point is covered by someone to some
26 extent on your positive list?

28 MR. MORRIS: Yes, I am trying to contact the other person on the
29 phone. I left a message on his answer phone last night.

31 MR. JUSTICE BELL: Yes. Can you give the names? You can either
32 read them out now, or if you would prefer just to hand a
33 list to Mrs. Brinley-Codd and to me, you can do it that
34 way.

38 MR. JUSTICE BELL: These are the ones who have replied in a
39 positive fashion, are they?

41 MR. MORRIS: These are the ones who have actually filled in the
42 form that I sent. I have spoken to some by phone anyway,
43 but I only spoke to a few because I was waiting for
44 replies, but Mr. Terry Pattison confirmed -- he is the
45 former Industrial Editor of the Daily Mirror -- Peter
46 Sutcliffe, Sarah Baker, Harriette Lamb, Kate, I think it
47 is, Harrison, it may be Kathy Harrison, and Seamac Alemi
48 have all confirmed. There are two, I am not sure whether
49 we put Civil Evidence Act notices on them or not, who are
50 abroad although they actually worked in this country, but
51 they were living abroad when they agreed last summer, or
52 the summer before, to be witnesses. That was Dave McGee
53 and Nick McGill. I cannot remember now whether we put
