Day 115 - 06 Apr 95 - Page 21

MR. RAMPTON: My Lord, day 18, page 39 -----

MR. JUSTICE BELL: I would much rather you gave me dates. By
all means give the day number as well.

MR. RAMPTON: Sorry, my Lord, 26th July.

MR. JUSTICE BELL: I do not live my life by day numbers, I am
afraid.

MR. RAMPTON: I agree, nor do I. 26th July 1994, page 39, lines
7 to 23 and, in particular, lines 22 and 23. This is a
description by Dr. Gregory of what he saw in the stunning
pen which he described as "a subtle way of doing it, not
commonly used, at least I have never seen that done", he
said, "to such sophistication or such a high level anywhere
else." I asked: "Will you advise other people to try that
technique?" Answer: "I certainly will".

MS. STEEL: As I recall, that was moving the pigs. Certainly,
if you look at day ------

MR. RAMPTON: This is in the stunning pen.

MR. JUSTICE BELL: Will everyone calm down. I am going to rise
and we will come back tomorrow and continue with this case.

MR. RAMPTON: My Lord, I will sit down. I will allow the
Defendants to read the passage to which I have just
referred your Lordship.

MR. JUSTICE BELL: It would be helpful if I was given time to
read the passage myself rather than having a squabble about
what is going without me getting a chance to look at it.

MR. RAMPTON: I apologise, my Lord, that is quite right. If
I invite your Lordship's attention to that particular
passage, starting probably at line 7.

MR. JUSTICE BELL: I think the point being made is that what
Dr. Gregory approved of is the way they were ushered to the
point where they were being stunned.

MR. RAMPTON: Exactly.

MR. JUSTICE BELL: But that was happening singularly when he
observed it. I think the point being taken is that he did
not anywhere (and this may be right or wrong) see them
coming in in twos or threes and give his blessing to that.

MR. RAMPTON: No, I did actually qualify my question by
reminding Dr. Long of what Dr. Gregory saw was singularly.

MS. STEEL: Actually, that was not what I was objecting to.
I was objecting to the fact that Mr. Rampton said the
stunning procedure was to be recommended which is not the
case at all. He indicated that there was a risk that the
pigs could be caused distress at the very minimum. In
actual fact, the thing about pigs regaining consciousness
